11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 17, Business & Commerce Code, is amended | |
13 | 13 | by adding Subchapter E-1 to read as follows: | |
14 | 14 | SUBCHAPTER E-1. LABELING, ADVERTISING, AND SALE OF "ZERO | |
15 | 15 | EMISSIONS" PRODUCTS | |
16 | 16 | Sec. 17.71. "ZERO EMISSIONS" LABELING STANDARD. (a) In | |
17 | 17 | this section, "greenhouse gas emissions" has the meaning assigned | |
18 | 18 | by Section 382.05102, Health and Safety Code. | |
19 | 19 | (b) A product that is sold in this state may not use "zero | |
20 | 20 | emissions" or equivalent phrasing if: | |
21 | 21 | (1) the product produces greenhouse gas emissions when | |
22 | 22 | used; | |
23 | 23 | (2) greenhouse gas emissions were produced in the | |
24 | 24 | manufacturing of the product; or | |
25 | 25 | (3) greenhouse gas emissions are produced to provide | |
26 | 26 | electricity to charge the product's rechargeable battery. | |
27 | 27 | Sec. 17.72. DECEPTIVE TRADE PRACTICE. A violation of | |
28 | 28 | Section 17.71 is a deceptive trade practice under Subchapter E and | |
29 | 29 | is actionable under that subchapter. | |
30 | 30 | SECTION 2. This Act takes effect September 1, 2025. |
