77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the duty of a peace officer to request and render aid
1010 for an injured person.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 2B.0301(b), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (b) The peace officer is not required to request emergency
1515 medical services or provide first aid or treatment under Subsection
1616 (a) if:
1717 (1) making the request or providing the treatment
1818 would expose the officer or another person to a likely risk of
1919 serious bodily injury; or
2020 (2) the officer is injured and physically unable to
2121 make the request or provide the treatment.
2222 SECTION 2. Section 1701.2551(b), Occupations Code, is
2323 amended to read as follows:
2424 (b) The basic peace officer training course must include
2525 training on:
2626 (1) the prohibition against the intentional use of a
2727 choke hold, carotid artery hold, or similar neck restraint by a
2828 peace officer in searching or arresting a person, unless the
2929 officer reasonably believes the restraint is necessary to prevent
3030 serious bodily injury to or the death of the peace officer or
3131 another person;
3232 (2) the duty of a peace officer to intervene to stop or
3333 prevent another peace officer from using force against a person
3434 suspected of committing an offense if:
3535 (A) the amount of force exceeds that which is
3636 reasonable under the circumstances; and
3737 (B) the officer knows or should know that the
3838 other officer's use of force:
3939 (i) violates state or federal law;
4040 (ii) puts a person at risk of bodily injury,
4141 as that term is defined by Section 1.07, Penal Code, and is not
4242 immediately necessary to avoid imminent bodily injury to a peace
4343 officer or other person; and
4444 (iii) is not required to apprehend the
4545 person suspected of committing an offense; and
4646 (3) the duty of a peace officer [who encounters an
4747 injured person while discharging the officer's official duties] to
4848 [immediately and as necessary] request [emergency medical services
4949 personnel to provide the person with emergency medical services]
5050 and render [, while waiting for emergency medical services
5151 personnel to arrive, provide first] aid for an injured [or
5252 treatment to the] person as prescribed by Article 2B.0301, Code of
5353 Criminal Procedure [to the extent of the officer's skills and
5454 training, unless the request for emergency medical services
5555 personnel or the provision of first aid or treatment would expose
5656 the officer or another person to a risk of bodily injury or the
5757 officer is injured and physically unable to make the request or
5858 provide the treatment].
5959 SECTION 3. Section 1701.269(b), Occupations Code, is
6060 amended to read as follows:
6161 (b) The model training curriculum and model policies
6262 developed under Subsection (a) must include:
6363 (1) curriculum and policies for banning the use of a
6464 choke hold, carotid artery hold, or similar neck restraint by a
6565 peace officer in searching or arresting a person, unless the
6666 officer reasonably believes the restraint is necessary to prevent
6767 serious bodily injury to or the death of the peace officer or
6868 another person;
6969 (2) curriculum and policies regarding the duty of a
7070 peace officer to intervene to stop or prevent another peace officer
7171 from using force against a person suspected of committing an
7272 offense if:
7373 (A) the amount of force exceeds that which is
7474 reasonable under the circumstances; and
7575 (B) the officer knows or should know that the
7676 other officer's use of force:
7777 (i) violates state or federal law;
7878 (ii) puts a person at risk of bodily injury,
7979 as that term is defined by Section 1.07, Penal Code, and is not
8080 immediately necessary to avoid imminent bodily injury to a peace
8181 officer or other person; and
8282 (iii) is not required to apprehend the
8383 person suspected of committing an offense; and
8484 (3) curriculum and policies regarding the duty of a
8585 peace officer [who encounters an injured person while discharging
8686 the officer's official duties] to [immediately and as necessary]
8787 request [emergency medical services personnel to provide the person
8888 with emergency medical services] and render [, while waiting for
8989 emergency medical services personnel to arrive, provide first] aid
9090 for an injured [or treatment to the] person as prescribed by Article
9191 2B.0301, Code of Criminal Procedure [to the extent of the officer's
9292 skills and training, unless the request for emergency medical
9393 services personnel or the provision of first aid or treatment would
9494 expose the officer or another person to a risk of bodily injury or
9595 the officer is injured and physically unable to make the request or
9696 provide the treatment].
9797 SECTION 4. This Act takes effect September 1, 2025.
