66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to a limitation on the salary paid to officers and
99 employees of this state and political subdivisions of this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 659, Government Code, is
1212 amended by adding Section 659.0111 to read as follows:
1313 Sec. 659.0111. LIMITATION ON SALARY. Notwithstanding any
1414 other law, the taxpayer funded salary of a state officer or employee
1515 may not exceed the amount of the salary set by the biennial
1616 appropriations act for the governor.
1717 SECTION 2. Chapter 180, Local Government Code, is amended
1818 by adding Section 180.011 to read as follows:
1919 Sec. 180.011. LIMITATION ON SALARY FOR OFFICER OR EMPLOYEE
2020 OF POLITICAL SUBDIVISION. (a) In this section, "political
2121 subdivision" means a county, municipality, special district,
2222 school district, junior college district, or other political
2323 subdivision of this state.
2424 (b) Notwithstanding any other law, the taxpayer funded
2525 salary of an officer or employee of a political subdivision may not
2626 exceed the amount of the salary set by the General Appropriations
2727 Act for the governor.
2828 SECTION 3. Section 659.0111, Government Code, and Section
2929 180.011, Local Government Code, as added by this Act, apply only to
3030 a salary agreement or employment contract entered into on or after
3131 the effective date of this Act. A salary agreement or employment
3232 contract entered into before the effective date of this Act is
3333 governed by the law in effect at the time the agreement or contract
3434 was entered into, and the former law is continued in effect for that
3535 purpose.
3636 SECTION 4. This Act applies beginning with the state fiscal
3737 biennium that begins September 1, 2025.
3838 SECTION 5. This Act takes effect September 1, 2025.
