| 9 | 9 | | relating to a requirement that certain students, interns, |

| 10 | 10 | | residents, and fellows receiving a clinical education at public or |
|---|
| 11 | 11 | | nonprofit hospitals be provided leave to undergo an annual |
|---|
| 12 | 12 | | comprehensive health examination. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 312.004(d), Health and Safety Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (d) Except as otherwise provided by this chapter, the [The] |
|---|
| 17 | 17 | | contracting parties may determine the terms of and the |
|---|
| 18 | 18 | | consideration for a contract authorized under this section. |
|---|
| 19 | 19 | | SECTION 2. Chapter 312, Health and Safety Code, is amended |
|---|
| 20 | 20 | | by adding Section 312.0045 to read as follows: |
|---|
| 21 | 21 | | Sec. 312.0045. REQUIRED CONTRACT PROVISION: LEAVE FOR |
|---|
| 22 | 22 | | HEALTH EXAMINATION. A contract under Section 312.004 must require |
|---|
| 23 | 23 | | a public or nonprofit hospital to provide each student, intern, |
|---|
| 24 | 24 | | resident, and fellow who is enrolled at a contracting medical or |
|---|
| 25 | 25 | | dental unit or supported medical or dental school and who is |
|---|
| 26 | 26 | | receiving a clinical education at the public or nonprofit hospital |
|---|
| 27 | 27 | | at least six consecutive hours of leave each year to undergo a |
|---|
| 28 | 28 | | comprehensive health examination. The public or nonprofit hospital |
|---|
| 29 | 29 | | at which the student, intern, resident, or fellow is receiving the |
|---|
| 30 | 30 | | clinical education must offer to provide the examination at no |
|---|
| 31 | 31 | | charge. A public or nonprofit hospital may not reduce the amount of |
|---|
| 32 | 32 | | the compensation paid by the hospital to the student, intern, |
|---|
| 33 | 33 | | resident, or fellow, if any, for leave taken for the examination. |
|---|
| 34 | 34 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 35 | 35 | | to a contract entered into on or after the effective date of this |
|---|
| 36 | 36 | | Act. A contract entered into before the effective date of this Act |
|---|
| 37 | 37 | | is governed by the law in effect on the date the contract was |
|---|
| 38 | 38 | | entered into, and the former law is continued in effect for that |
|---|
| 39 | 39 | | purpose. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect September 1, 2025. |
