77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a requirement that certain students, interns,
1010 residents, and fellows receiving a clinical education at public or
1111 nonprofit hospitals be provided leave to undergo an annual
1212 comprehensive health examination.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 312.004(d), Health and Safety Code, is
1515 amended to read as follows:
1616 (d) Except as otherwise provided by this chapter, the [The]
1717 contracting parties may determine the terms of and the
1818 consideration for a contract authorized under this section.
1919 SECTION 2. Chapter 312, Health and Safety Code, is amended
2020 by adding Section 312.0045 to read as follows:
2121 Sec. 312.0045. REQUIRED CONTRACT PROVISION: LEAVE FOR
2222 HEALTH EXAMINATION. A contract under Section 312.004 must require
2323 a public or nonprofit hospital to provide each student, intern,
2424 resident, and fellow who is enrolled at a contracting medical or
2525 dental unit or supported medical or dental school and who is
2626 receiving a clinical education at the public or nonprofit hospital
2727 at least six consecutive hours of leave each year to undergo a
2828 comprehensive health examination. The public or nonprofit hospital
2929 at which the student, intern, resident, or fellow is receiving the
3030 clinical education must offer to provide the examination at no
3131 charge. A public or nonprofit hospital may not reduce the amount of
3232 the compensation paid by the hospital to the student, intern,
3333 resident, or fellow, if any, for leave taken for the examination.
3434 SECTION 3. The change in law made by this Act applies only
3535 to a contract entered into on or after the effective date of this
3636 Act. A contract entered into before the effective date of this Act
3737 is governed by the law in effect on the date the contract was
3838 entered into, and the former law is continued in effect for that
3939 purpose.
4040 SECTION 4. This Act takes effect September 1, 2025.
