75 A BILL TO BE ENTITLED
86 AN ACT
97 relating to the reporting by law enforcement agencies of missing
108 children to the National Center for Missing and Exploited Children.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Article 63.00905(a), Code of Criminal Procedure,
1311 as added by Chapter 729 (H.B. 2660), Acts of the 88th Legislature,
1412 Regular Session, 2023, is amended to read as follows:
1513 (a) Regardless of the jurisdiction in which the child went
1614 missing, a law enforcement agency, on receiving a report of a
1715 missing child, shall:
1816 (1) immediately start an investigation in order to
1917 determine the present location of the child;
2018 (2) immediately, but not later than two hours after
2119 receiving the report, enter the name of the child into the
2220 clearinghouse and the national crime information center missing
2321 person file if the child meets the center's criteria, with all
2422 available identifying features such as dental records,
2523 fingerprints, other physical characteristics, and a description of
2624 the clothing worn when last seen, and all available information
2725 describing any person reasonably believed to have taken or retained
2826 the missing child;
2927 (3) immediately, but not later than two hours after
3028 the agency receives the report, enter the applicable information
3129 into:
3230 (A) the Texas Law Enforcement Telecommunications
3331 System or a successor system of telecommunication used by law
3432 enforcement agencies and operated by the Department of Public
3533 Safety; and
3634 (B) the National Center for Missing and Exploited
3735 Children;
3836 (4) not later than 48 hours after receiving the
3937 report, electronically submit to each municipal or county law
4038 enforcement agency within 200 miles the report and any information
4139 that may help determine the present location of the child;
4240 (5) not later than the 30th day after the date the
4341 agency receives the report, enter the name of the child into the
4442 National Missing and Unidentified Persons System, with all
4543 available identifying features such as dental records,
4644 fingerprints, other physical characteristics, and a description of
4745 the clothing worn when last seen, and all available information
4846 describing any person reasonably believed to have taken or retained
4947 the missing child; and
5048 (6) inform the person who filed the report of the
5149 missing child that the information will be:
5250 (A) entered into the clearinghouse, the national
5351 crime information center missing person file, the National Center
5452 for Missing and Exploited Children, and the National Missing and
5553 Unidentified Persons System; and
5654 (B) submitted to each municipal or county law
5755 enforcement agency within 200 miles.
5856 SECTION 2. Article 63.00905(a), Code of Criminal Procedure,
5957 as added by Chapter 979 (S.B. 2429), Acts of the 88th Legislature,
6058 Regular Session, 2023, is repealed as duplicative of Article
6159 63.00905(a), Code of Criminal Procedure, as added by Chapter 729
6260 (H.B. 2660), Acts of the 88th Legislature, Regular Session, 2023.
6361 SECTION 3. This Act takes effect September 1, 2025.
