76 AN ACT
87 relating to the compensation of a distributed renewable generation
98 owner in certain areas outside of ERCOT.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11- SECTION 1. Section 39.554, Utilities Code, is amended by
12- amending Subsection (f) and adding Subsection (i) to read as
13- follows:

1412 (f) Unless the commission approves an alternative method
1513 for compensating a distributed renewable generation owner for
1614 electricity generated by distributed renewable generation or a
1715 qualifying facility, for [For] a distributed renewable generation
1816 owner that chooses interconnection through a single meter under
1917 Subsection (e):
2018 (1) the amount of electricity the owner generates
2119 through distributed renewable generation or a qualifying facility
2220 for a given billing period offsets the owner's consumption for that
2321 billing period; and
2422 (2) any electricity the owner generates through
2523 distributed renewable generation or a qualifying facility that
2624 exceeds the owner's consumption for a given billing period shall be
2725 credited to the owner under Subsection (g).
28- (i) Before approving an alternative method for compensating
29- a distributed renewable generation owner for electricity generated
30- by distributed renewable generation or a qualifying facility, the
31- commission shall require the electric utility to conduct and submit
32- to the commission a comprehensive cost-benefit analysis using
33- established best practices to justify the rates of compensation and
34- any associated fees. The commission must consider the
35- comprehensive cost-benefit analysis before approving alternative
36- rates for compensating distributed renewable generation owners or
37- the continuation of net metering, including any rates or fees that
38- apply only to distributed renewable generation owners and reflect
39- the value provided by the distributed renewable generation or
40- qualifying facility.
41- SECTION 2. This Act takes effect September 1, 2026.
