| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 437, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 437.0055 to read as follows: |
|---|
| 14 | 14 | | Sec. 437.0055. CONGRESSIONAL ACTION REQUIRED FOR ACTIVE |
|---|
| 15 | 15 | | COMBAT DUTY ACTIVATION OF TEXAS NATIONAL GUARD. (a) In this |
|---|
| 16 | 16 | | section, "active combat duty" means active military service |
|---|
| 17 | 17 | | through: |
|---|
| 18 | 18 | | (1) participation in an armed conflict in a foreign |
|---|
| 19 | 19 | | state; |
|---|
| 20 | 20 | | (2) performance of a hazardous service relating to an |
|---|
| 21 | 21 | | armed conflict in a foreign state; or |
|---|
| 22 | 22 | | (3) performance of a duty through an instrumentality |
|---|
| 23 | 23 | | of war. |
|---|
| 24 | 24 | | (b) Notwithstanding any other provision of this code, the |
|---|
| 25 | 25 | | Texas National Guard may be activated into active combat duty only |
|---|
| 26 | 26 | | if the United States Congress: |
|---|
| 27 | 27 | | (1) officially declares war in accordance with Clause |
|---|
| 28 | 28 | | 11, Section 8, Article I, United States Constitution; or |
|---|
| 29 | 29 | | (2) takes other official action in accordance with |
|---|
| 30 | 30 | | Clause 15, Section 8, Article I, United States Constitution. |
|---|
| 31 | 31 | | (c) The governor shall take all actions necessary to comply |
|---|
| 32 | 32 | | with this section. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
