| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Chapter 669, Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | CHAPTER 669. RESTRICTIONS [ON CERTAIN ACTIONS] INVOLVING CERTAIN |
|---|
| 14 | 14 | | STATE EMPLOYEES [EXECUTIVE HEAD OF STATE AGENCY] |

| 15 | 15 | | SECTION 2. Chapter 669, Government Code, is amended by |
|---|
| 16 | 16 | | adding Section 669.005 to read as follows: |
|---|
| 17 | 17 | | Sec. 669.005. LIMITATION ON EMPLOYMENT DURATION FOR CERTAIN |
|---|
| 18 | 18 | | POSITIONS; DUTY TO REVIEW. (a) This section applies only to: |
|---|
| 19 | 19 | | (1) the executive head of a state agency that is |
|---|
| 20 | 20 | | governed by a governing body; and |
|---|
| 21 | 21 | | (2) an employee in a position that reports directly to |
|---|
| 22 | 22 | | the executive head described by Subdivision (1). |
|---|
| 23 | 23 | | (b) An individual may not serve as the executive head of a |
|---|
| 24 | 24 | | state agency, or in a position that reports directly to the |
|---|
| 25 | 25 | | executive head of the state agency, for a period that exceeds 10 |
|---|
| 26 | 26 | | years. |
|---|
| 27 | 27 | | (c) Not later than the fifth anniversary of the date an |
|---|
| 28 | 28 | | individual is employed: |
|---|
| 29 | 29 | | (1) as the executive head of a state agency, the |
|---|
| 30 | 30 | | governing body of the state agency shall review the individual's |
|---|
| 31 | 31 | | performance and determine whether to terminate the individual's |
|---|
| 32 | 32 | | employment; or |
|---|
| 33 | 33 | | (2) in a position that reports directly to the |
|---|
| 34 | 34 | | executive head of the state agency, the executive head shall review |
|---|
| 35 | 35 | | the individual's performance and determine whether to terminate the |
|---|
| 36 | 36 | | individual's employment. |
|---|
| 37 | 37 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 38 | 38 | | to a contract entered into on or after the effective date of this |
|---|
| 39 | 39 | | Act. A contract entered into before the effective date of this Act |
|---|
| 40 | 40 | | is governed by the law in effect on the date the contract was |
|---|
| 41 | 41 | | entered into, and the former law is continued in effect for that |
|---|
| 42 | 42 | | purpose. |
|---|
| 43 | 43 | | SECTION 4. This Act takes effect September 1, 2025. |
