| 9 | 9 | | relating to the procedure by which certain special districts are |

| 10 | 10 | | required to provide notice of certain matters. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 49.063, Water Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (a) and adding Subsections (a-1) and (a-2) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) Except as provided by Subsection (a-1), notice [Notice] |
|---|
| 16 | 16 | | of meetings of the board shall be given as set forth in the open |
|---|
| 17 | 17 | | meetings law, Chapter 551, Government Code. |
|---|
| 18 | 18 | | (a-1) If[, except that if] a district does not have a |
|---|
| 19 | 19 | | meeting place within the district, the district shall post notice |
|---|
| 20 | 20 | | of its meeting: |
|---|
| 21 | 21 | | (1) on the district's Internet website; or |
|---|
| 22 | 22 | | (2) if the district does not maintain an Internet |
|---|
| 23 | 23 | | website, at a public place within the district specified by the |
|---|
| 24 | 24 | | board in a written resolution[, rather than at its administrative |
|---|
| 25 | 25 | | office]. |
|---|
| 26 | 26 | | (a-2) A [The board shall specify such] public place |
|---|
| 27 | 27 | | specified by the board for the posting of notice under Subsection |
|---|
| 28 | 28 | | (a-1)(2) must [to] be a bulletin board or other place within the |
|---|
| 29 | 29 | | district which is reasonably available to the public. |
|---|
| 30 | 30 | | SECTION 2. Section 49.113, Water Code, is amended to read as |
|---|
| 31 | 31 | | follows: |
|---|
| 32 | 32 | | Sec. 49.113. NOTICE FOR FILING FOR PLACE ON BALLOT. (a) A |
|---|
| 33 | 33 | | notice required by Section 141.040, Election Code, must be posted: |
|---|
| 34 | 34 | | (1) at the district's administrative office in the |
|---|
| 35 | 35 | | district; or |
|---|
| 36 | 36 | | (2) if the district does not have an administrative |
|---|
| 37 | 37 | | office in the district, in the manner required by Section |
|---|
| 38 | 38 | | 49.063(a-1) of this code for a notice subject to Section 49.063. |
|---|
| 39 | 39 | | (b) The notice must be posted [at the public place |
|---|
| 40 | 40 | | established by the district under Section 49.063 of this chapter] |
|---|
| 41 | 41 | | not later than the 30th day before the deadline for a candidate to |
|---|
| 42 | 42 | | file an application for a place on the ballot of a district |
|---|
| 43 | 43 | | directors' election. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2025. |
