88 AN ACT
99 relating to a liability limit for noneconomic damages for personal
1010 injury claims.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 41, Civil Practice and Remedies Code, is
1313 amended by adding Section 41.0025 to read as follows:
1414 Sec. 41.0025. LIABILITY LIMIT FOR NONECONOMIC DAMAGES. In
1515 an action on a personal injury claim, civil liability of a defendant
1616 for noneconomic damages is limited to an amount not to exceed, for
1717 each claimant, the greater of:
1818 (1) five times the economic damages; or
1919 (2) $5 million.
2020 SECTION 2. Section 41.0025, Civil Practice and Remedies
2121 Code, as added by this Act, is an exercise of authority under
2222 Section 66(c), Article III, Texas Constitution, and takes effect
2323 only if this Act receives a vote of three-fifths of all the members
2424 elected to each house, as provided by Subsection (e) of that
2525 section.
2626 SECTION 3. Section 41.0025, Civil Practice and Remedies
2727 Code, as added by this Act, applies only to an action filed on or
2828 after the effective date of this Act.
2929 SECTION 4. This Act takes effect January 1, 2026.
