11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 41, Civil Practice and Remedies Code, is | |
13 | 13 | amended by adding Section 41.0025 to read as follows: | |
14 | 14 | Sec. 41.0025. LIABILITY LIMIT FOR NONECONOMIC DAMAGES. In | |
15 | 15 | an action on a personal injury claim, civil liability of a defendant | |
16 | 16 | for noneconomic damages is limited to an amount not to exceed, for | |
17 | 17 | each claimant, the greater of: | |
18 | 18 | (1) five times the economic damages; or | |
19 | 19 | (2) $5 million. | |
20 | 20 | SECTION 2. Section 41.0025, Civil Practice and Remedies | |
21 | 21 | Code, as added by this Act, is an exercise of authority under | |
22 | 22 | Section 66(c), Article III, Texas Constitution, and takes effect | |
23 | 23 | only if this Act receives a vote of three-fifths of all the members | |
24 | 24 | elected to each house, as provided by Subsection (e) of that | |
25 | 25 | section. | |
26 | 26 | SECTION 3. Section 41.0025, Civil Practice and Remedies | |
27 | 27 | Code, as added by this Act, applies only to an action filed on or | |
28 | 28 | after the effective date of this Act. | |
29 | 29 | SECTION 4. This Act takes effect January 1, 2026. |
