10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter I, Chapter 545, Transportation Code, | |
12 | 12 | is amended by adding Section 545.429 to read as follows: | |
13 | 13 | Sec. 545.429. USE OF HIGH OCCUPANCY VEHICLE LANE TO PASS | |
14 | 14 | CERTAIN VEHICLES. Regardless of the number of occupants in a motor | |
15 | 15 | vehicle, an operator of a motor vehicle is entitled to use any high | |
16 | 16 | occupancy vehicle lane in this state for the sole purpose of passing | |
17 | 17 | another vehicle that is being operated at a speed that is less than | |
18 | 18 | the posted speed limit for the roadway if the operator enters and | |
19 | 19 | exits the high occupancy vehicle lane at designated entry and exit | |
20 | 20 | points. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2025. |
