| 9 | 9 | | relating to a limitation on the salary of superintendents and chief |

| 10 | 10 | | executive officers of school districts and open-enrollment charter |
|---|
| 11 | 11 | | schools. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 11.201, Education Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (b-1) to read as follows: |
|---|
| 15 | 15 | | (b-1) A school district may not employ a superintendent for |
|---|
| 16 | 16 | | an annual salary in an amount that is greater than the amount of the |
|---|
| 17 | 17 | | annual salary authorized by the legislature for the governor. For |
|---|
| 18 | 18 | | purposes of this subsection, a superintendent's annual salary: |
|---|
| 19 | 19 | | (1) includes an amount paid by the district as a bonus; |
|---|
| 20 | 20 | | and |
|---|
| 21 | 21 | | (2) does not include an amount paid by the district as |
|---|
| 22 | 22 | | an allowance or stipend. |
|---|
| 23 | 23 | | SECTION 2. Section 12.136, Education Code, is amended to |
|---|
| 24 | 24 | | read as follows: |
|---|
| 25 | 25 | | Sec. 12.136. [POSTING OF] CHIEF EXECUTIVE OFFICER SALARY. |
|---|
| 26 | 26 | | (a) An open-enrollment charter school: |
|---|
| 27 | 27 | | (1) may not employ a superintendent or, as applicable, |
|---|
| 28 | 28 | | an administrator serving as educational leader and chief executive |
|---|
| 29 | 29 | | officer for an annual salary in an amount that is greater than the |
|---|
| 30 | 30 | | amount of the annual salary authorized by the legislature for the |
|---|
| 31 | 31 | | governor; and |
|---|
| 32 | 32 | | (2) shall post on the school's Internet website the |
|---|
| 33 | 33 | | salary of the school's superintendent or, as applicable, of the |
|---|
| 34 | 34 | | administrator serving as educational leader and chief executive |
|---|
| 35 | 35 | | officer. |
|---|
| 36 | 36 | | (b) For purposes of Subsection (a), a superintendent's or |
|---|
| 37 | 37 | | chief executive officer's annual salary: |
|---|
| 38 | 38 | | (1) includes an amount paid by the school as a bonus; |
|---|
| 39 | 39 | | and |
|---|
| 40 | 40 | | (2) does not include an amount paid by the school as an |
|---|
| 41 | 41 | | allowance or stipend. |
|---|
| 42 | 42 | | SECTION 3. This Act applies to an employment contract that |
|---|
| 43 | 43 | | is entered into on or after September 1, 2025. An employment |
|---|
| 44 | 44 | | contract that is entered into before September 1, 2025, is governed |
|---|
| 45 | 45 | | by the law as it existed at the time the contract was entered into, |
|---|
| 46 | 46 | | and the former law remains in effect for that purpose. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect September 1, 2025. |
