77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a limitation on the salary of superintendents and chief
1010 executive officers of school districts and open-enrollment charter
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 11.201, Education Code, is amended by
1414 adding Subsection (b-1) to read as follows:
1515 (b-1) A school district may not employ a superintendent for
1616 an annual salary in an amount that is greater than the amount of the
1717 annual salary authorized by the legislature for the governor. For
1818 purposes of this subsection, a superintendent's annual salary:
1919 (1) includes an amount paid by the district as a bonus;
2020 and
2121 (2) does not include an amount paid by the district as
2222 an allowance or stipend.
2323 SECTION 2. Section 12.136, Education Code, is amended to
2424 read as follows:
2525 Sec. 12.136. [POSTING OF] CHIEF EXECUTIVE OFFICER SALARY.
2626 (a) An open-enrollment charter school:
2727 (1) may not employ a superintendent or, as applicable,
2828 an administrator serving as educational leader and chief executive
2929 officer for an annual salary in an amount that is greater than the
3030 amount of the annual salary authorized by the legislature for the
3131 governor; and
3232 (2) shall post on the school's Internet website the
3333 salary of the school's superintendent or, as applicable, of the
3434 administrator serving as educational leader and chief executive
3535 officer.
3636 (b) For purposes of Subsection (a), a superintendent's or
3737 chief executive officer's annual salary:
3838 (1) includes an amount paid by the school as a bonus;
3939 and
4040 (2) does not include an amount paid by the school as an
4141 allowance or stipend.
4242 SECTION 3. This Act applies to an employment contract that
4343 is entered into on or after September 1, 2025. An employment
4444 contract that is entered into before September 1, 2025, is governed
4545 by the law as it existed at the time the contract was entered into,
4646 and the former law remains in effect for that purpose.
4747 SECTION 4. This Act takes effect September 1, 2025.
