10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 192.002, Health and Safety Code, is | |
12 | 12 | amended by adding Subsection (c-1) to read as follows: | |
13 | 13 | (c-1) The form must include a space for recording the | |
14 | 14 | biological sex of a child as either male or female. A child born | |
15 | 15 | with a Y chromosome must be classified as male and a child born | |
16 | 16 | without a Y chromosome must be classified as female. The method of | |
17 | 17 | classifying a child's biological sex used under this section | |
18 | 18 | applies to other laws of this state with respect to the | |
19 | 19 | determination of a person's sex or gender. | |
20 | 20 | SECTION 2. As soon as practicable after the effective date | |
21 | 21 | of this Act, the executive commissioner of the Health and Human | |
22 | 22 | Services Commission shall adopt rules necessary to implement the | |
23 | 23 | changes in law made by this Act. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2025. |
