77 AN ACT
88 relating to the required inclusion of a person's sex on a birth
99 certificate.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 192.002, Health and Safety Code, is
1212 amended by adding Subsection (c-1) to read as follows:
1313 (c-1) The form must include a space for recording the
1414 biological sex of a child as either male or female. A child born
1515 with a Y chromosome must be classified as male and a child born
1616 without a Y chromosome must be classified as female. The method of
1717 classifying a child's biological sex used under this section
1818 applies to other laws of this state with respect to the
1919 determination of a person's sex or gender.
2020 SECTION 2. As soon as practicable after the effective date
2121 of this Act, the executive commissioner of the Health and Human
2222 Services Commission shall adopt rules necessary to implement the
2323 changes in law made by this Act.
2424 SECTION 3. This Act takes effect September 1, 2025.
