66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to defenses to prosecution for certain criminal offenses
99 involving material or conduct that may be obscene or is otherwise
1010 harmful to children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 43.24, Penal Code, is amended by
1313 amending Subsection (c) and adding Subsection (c-2) to read as
1414 follows:
1515 (c) It is not a [an affirmative] defense to prosecution
1616 under this section that the sale, distribution, or exhibition was
1717 by a person having scientific, educational, governmental, or other
1818 similar justification.
1919 (c-2) It is a defense to prosecution under Subsection (b)(1)
2020 or (2) that at the time of the offense the actor was a judicial or
2121 law enforcement officer discharging the officer's official duties.
2222 SECTION 2. Section 43.25(f), Penal Code, is amended to read
2323 as follows:
2424 (f) It is an affirmative defense to a prosecution under this
2525 section that:
2626 (1) the defendant was the spouse of the child at the
2727 time of the offense;
2828 (2) the conduct was for a bona fide [educational,
2929 medical, psychological, psychiatric,] judicial or [,] law
3030 enforcement[, or legislative] purpose; or
3131 (3) the defendant is not more than two years older than
3232 the child.
3333 SECTION 3. The changes in law made by this Act apply only to
3434 an offense committed on or after the effective date of this Act. An
3535 offense committed before the effective date of this Act is governed
3636 by the law in effect on the date the offense was committed, and the
3737 former law is continued in effect for that purpose. For purposes of
3838 this section, an offense was committed before the effective date of
3939 this Act if any element of the offense occurred before that date.
4040 SECTION 4. This Act takes effect September 1, 2025.
