7	7	CONCURRENT RESOLUTION
8	8	WHEREAS, The Texas Legislature for each of the last 21
9	9	regular sessions has adopted a concurrent resolution authorizing
10	10	the creation and appointment of joint legislative study committees
11	11	by the lieutenant governor and speaker of the House of
12	12	Representatives; and
13	13	WHEREAS, Renewal of the prior authorizations to the presiding
14	14	officers enables the Legislature to address and study issues that
15	15	remain unresolved on sine die adjournment or that emerge subsequent
16	16	to that time; and
17	17	WHEREAS, It is also desirable to adopt by resolution various
18	18	rules and policies regarding the operation of joint committees to
19	19	supplement, and reconcile differences between, the Senate and House
20	20	rules of procedure; now, therefore, be it
21	21	RESOLVED, That the 89th Legislature of the State of Texas
22	22	hereby authorize the lieutenant governor and speaker of the House
23	23	of Representatives to create by mutual agreement such joint
24	24	committees as they consider necessary during the term of this
25	25	legislature; and, be it further
26	26	RESOLVED, That each joint committee created pursuant to this
27	27	resolution be composed of such combination of legislators, state
28	28	officials, or citizen members as shall be determined mutually by
29	29	the presiding officers of each house; and, be it further
30	30	RESOLVED, That on the request of the presiding officers, the
31	31	governor may appoint members to a joint committee created pursuant
32	32	to this resolution; and, be it further
33	33	RESOLVED, That the presiding officers issue for each
34	34	committee so created a joint proclamation identifying the issue or
35	35	issues to be studied and listing the committee membership or
36	36	describing the committee composition and that the proclamation be
37	37	filed with the secretary of the Senate and the chief clerk of the
38	38	House of Representatives; and, be it further
39	39	RESOLVED, That the presiding officers designate jointly a
40	40	chair, or designate alternatively two co-chairs, from among the
41	41	committee membership; and, be it further
42	42	RESOLVED, That the chair or co-chairs, acting jointly and
43	43	within four weeks of the proclamation, prepare and present to the
44	44	presiding officers a proposal for budget and staffing; and, be it
45	45	further
46	46	RESOLVED, That the chair or co-chairs be directed to use to
47	47	the greatest extent possible the existing staff and administrative
48	48	resources of committee members, standing committees, officers of
49	49	the Senate and House, and legislative service agencies; and, be it
50	50	further
51	51	RESOLVED, That the presiding officers jointly review each
52	52	budget and staffing proposal, adopt budgetary and staffing
53	53	allocations, and determine the manner in which each joint committee
54	54	is to be funded; and, be it further
55	55	RESOLVED, That the joint committee chair, or the co-chairs
56	56	acting by mutual agreement, have authority to create and appoint
57	57	subcommittees or affiliated advisory panels and to designate
58	58	respective chairs for each, contingent on the advance approval of
59	59	the presiding officers for the creation and appointment of
60	60	subcommittees or advisory panels containing membership external to
61	61	the committee; and, be it further
62	62	RESOLVED, That each joint committee, and its subcommittees
63	63	and advisory panels, convene at the call of its chair or co-chairs;
64	64	provided that no joint committee, nor its subcommittees or advisory
65	65	panels, shall convene in a public hearing or other meeting for the
66	66	transaction of business unless public notice has been posted by its
67	67	chair or co-chairs at the locations specified by the Senate and
68	68	House rules of procedure for posting of notice of standing
69	69	committee meetings at least five calendar days in advance of the
70	70	hearing or meeting; and, be it further
71	71	RESOLVED, That the preceding clause be construed, for
72	72	purposes of Section 551.046, Government Code, as a joint rule of the
73	73	Senate and House of Representatives controlling the posting of
74	74	notice for joint committees, and their subcommittees and advisory
75	75	panels, in lieu of required posting with the secretary of state;
76	76	and, be it further
77	77	RESOLVED, That each joint committee have authority to issue
78	78	process as provided in Sections 301.024-301.027, Government Code,
79	79	provided that any motion for the issuance of process must receive
80	80	the record vote of at least two-thirds of those present and voting,
81	81	a quorum being present; and, be it further
82	82	RESOLVED, That each joint committee be entitled to accept
83	83	grants and donations as provided by Sections 301.032(b) and (c),
84	84	Government Code, and that, on expiration of a joint committee, any
85	85	unexpended funds remaining from a grant or donation be transferred
86	86	in equal proportions to the accounts of the Senate and House of
87	87	Representatives unless otherwise provided by the grantor or donor;
88	88	and, be it further
89	89	RESOLVED, That each joint committee, except as modified by or
90	90	pursuant to this resolution, have all other powers and duties
91	91	provided to special committees by Subchapter B, Chapter 301,
92	92	Government Code, and the Senate and House rules of procedure; and,
93	93	be it further
94	94	RESOLVED, That the operating accounts for each joint
95	95	committee created pursuant to this resolution and any grants and
96	96	donations that such committee may receive be administered by the
97	97	accounting and purchasing sections of the Texas Legislative
98	98	Council; and, be it further
99	99	RESOLVED, That the Texas Legislative Council, under the
100	100	guidance of the presiding officers, be responsible for preparing
101	101	and maintaining a manual of procedures for joint committees and
102	102	other entities created by the legislature for which funds are to be
103	103	administered by the Texas Legislative Council; the manual must
104	104	establish requirements relating to printing needs, accounting
105	105	procedures, ultimate disposition of records, and other
106	106	administrative and financial matters; and, be it further
107	107	RESOLVED, That citizen members appointed by the lieutenant
108	108	governor or speaker of the House of Representatives to joint
109	109	committees created pursuant to this resolution be reimbursed from
110	110	funds appropriated to the Texas Legislative Council for expenses of
111	111	transportation, meals, lodging, and incidentals for travel on
112	112	official committee business, at rates established by the joint
113	113	chairs of the Texas Legislative Council consistent with provisions
114	114	of the General Appropriations Act; and, be it further
115	115	RESOLVED, That citizen members appointed by the governor to
116	116	joint committees created pursuant to this resolution be reimbursed
117	117	from funds appropriated to the office of the governor for expenses
118	118	of travel on official committee business, at rates established by
119	119	the joint chairs of the Texas Legislative Council consistent with
120	120	provisions of the General Appropriations Act; and, be it further
121	121	RESOLVED, That citizen members appointed by the lieutenant
122	122	governor to Senate select committees and citizen members appointed
123	123	by the speaker of the House of Representatives to House committees
124	124	expanded or created under House Rule 4, Sections 24, 57, and 58,
125	125	when engaged in travel on official committee business, be
126	126	reimbursed for (1) transportation expenses at the same rates as
127	127	authorized for state employees by the General Appropriations Act,
128	128	and (2) actual expenses for meals, lodging, and incidentals,
129	129	subject to any maximum reimbursement limitations for meals and
130	130	lodging set by the Senate Committee on Administration for Senate
131	131	select committees and by the House Administration Committee for
132	132	House select committees; and, be it further
133	133	RESOLVED, That the Texas Legislative Council be authorized to
134	134	reimburse the Senate and House of Representatives for expenses
135	135	incurred by members of the Senate and House for transportation,
136	136	meals, lodging, and incidentals for travel on official business of
137	137	joint committees created pursuant to this resolution; and, be it
138	138	further
139	139	RESOLVED, That the final report of each joint committee be
140	140	approved by a majority of the voting membership of the committee;
141	141	dissenting voting members may attach statements to the final report
142	142	subject to any limitations specified in the rules adopted by the
143	143	committee; and, be it further
144	144	RESOLVED, That each joint committee created pursuant to this
145	145	resolution expire on January 12, 2027, or an earlier date specified
146	146	in the proclamation creating the committee.
