77 A JOINT RESOLUTION
88 proposing a constitutional amendment protecting the right to engage
99 in the exploration for and production and export of oil, gas, and
1010 other minerals.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article I, Texas Constitution, is amended by
1313 adding Section 37 to read as follows:
1414 Sec. 37. (a) In this section, "mineral" means oil, gas,
1515 uranium, sulphur, lignite, coal, and any other substance that is
1616 ordinarily and naturally considered a mineral in this state,
1717 regardless of the depth at which the oil, gas, uranium, sulphur,
1818 lignite, coal, or other substance is found.
1919 (b) The people have the right to engage in generally
2020 accepted practices concerning the exploration for and production
2121 and export of minerals.
2222 (c) This section does not affect the authority of the
2323 legislature to authorize by general law the regulation of generally
2424 accepted practices concerning the exploration for and production
2525 and export of minerals by:
2626 (1) a state agency or political subdivision when there
2727 is clear and convincing evidence that the law or regulation is
2828 necessary to protect the public health and safety from imminent
2929 danger; or
3030 (2) a state agency or political subdivision to
3131 preserve or conserve the natural resources of this state under
3232 Section 59, Article XVI, of this constitution.
3333 (d) This section does not affect the authority of the
3434 legislature to authorize by general law the use or acquisition of
3535 property for a public use, including the development of the natural
3636 resources of this state under Section 59, Article XVI, of this
3737 constitution.
3838 SECTION 2. This proposed constitutional amendment shall be
3939 submitted to the voters at an election to be held November 4, 2025.
4040 The ballot shall be printed to permit voting for or against the
4141 proposition: "The constitutional amendment protecting the right to
4242 engage in the exploration for and production and export of oil, gas,
4343 and other minerals."
