| 8 | 8 | | proposing a constitutional amendment protecting the right to engage |
|---|
| 9 | 9 | | in the exploration for and production and export of oil, gas, and |
|---|
| 10 | 10 | | other minerals. |
|---|
| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article I, Texas Constitution, is amended by |
|---|
| 13 | 13 | | adding Section 37 to read as follows: |
|---|
| 14 | 14 | | Sec. 37. (a) In this section, "mineral" means oil, gas, |
|---|
| 15 | 15 | | uranium, sulphur, lignite, coal, and any other substance that is |
|---|
| 16 | 16 | | ordinarily and naturally considered a mineral in this state, |
|---|
| 17 | 17 | | regardless of the depth at which the oil, gas, uranium, sulphur, |
|---|
| 18 | 18 | | lignite, coal, or other substance is found. |
|---|
| 19 | 19 | | (b) The people have the right to engage in generally |
|---|
| 20 | 20 | | accepted practices concerning the exploration for and production |
|---|
| 21 | 21 | | and export of minerals. |
|---|
| 22 | 22 | | (c) This section does not affect the authority of the |
|---|
| 23 | 23 | | legislature to authorize by general law the regulation of generally |
|---|
| 24 | 24 | | accepted practices concerning the exploration for and production |
|---|
| 25 | 25 | | and export of minerals by: |
|---|
| 26 | 26 | | (1) a state agency or political subdivision when there |
|---|
| 27 | 27 | | is clear and convincing evidence that the law or regulation is |
|---|
| 28 | 28 | | necessary to protect the public health and safety from imminent |
|---|
| 29 | 29 | | danger; or |
|---|
| 30 | 30 | | (2) a state agency or political subdivision to |
|---|
| 31 | 31 | | preserve or conserve the natural resources of this state under |
|---|
| 32 | 32 | | Section 59, Article XVI, of this constitution. |
|---|
| 33 | 33 | | (d) This section does not affect the authority of the |
|---|
| 34 | 34 | | legislature to authorize by general law the use or acquisition of |
|---|
| 35 | 35 | | property for a public use, including the development of the natural |
|---|
| 36 | 36 | | resources of this state under Section 59, Article XVI, of this |
|---|
| 37 | 37 | | constitution. |
|---|
| 38 | 38 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 39 | 39 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 40 | 40 | | The ballot shall be printed to permit voting for or against the |
|---|
| 41 | 41 | | proposition: "The constitutional amendment protecting the right to |
|---|
| 42 | 42 | | engage in the exploration for and production and export of oil, gas, |
|---|
| 43 | 43 | | and other minerals." |
