77 A JOINT RESOLUTION
88 proposing a constitutional amendment providing that federal
99 authority to regulate the manufacture, possession, sale, or use of
1010 firearms, firearm accessories, and ammunition in this state is not
1111 recognized by this state.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 23, Article I, Texas Constitution, is
1414 amended to read as follows:
1515 Sec. 23. (a) Every citizen shall have the right to keep and
1616 bear arms in the lawful defence of himself or the State; but the
1717 Legislature shall have power, by law, to regulate the wearing of
1818 arms, with a view to prevent crime.
1919 (b) This state does not recognize any authority purportedly
2020 held by the federal government to regulate the manufacture,
2121 possession, sale, or use of firearms, firearm accessories, and
2222 ammunition in this state.
2323 SECTION 2. This proposed constitutional amendment shall be
2424 submitted to the voters at an election to be held November 4, 2025.
2525 The ballot shall be printed to permit voting for or against the
2626 proposition: "The constitutional amendment providing that federal
2727 authority to regulate the manufacture, possession, sale, or use of
2828 firearms, firearm accessories, and ammunition in this state is not
2929 recognized by this state."
