| 12 | 12 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 1(c), Article XVII, Texas Constitution, |
|---|
| 14 | 14 | | is amended to read as follows: |
|---|
| 15 | 15 | | (c) The election shall be held in accordance with procedures |
|---|
| 16 | 16 | | prescribed by the Legislature, and the returning officer in each |
|---|
| 17 | 17 | | county shall make returns to the Secretary of State of the number of |
|---|
| 18 | 18 | | legal votes cast at the election for and against each amendment. If |
|---|
| 19 | 19 | | it appears from the returns that in at least three-fourths of the |
|---|
| 20 | 20 | | counties in this state a majority of the votes cast have been cast |
|---|
| 21 | 21 | | in favor of an amendment, it shall become a part of this |
|---|
| 22 | 22 | | Constitution, and proclamation thereof shall be made by the |
|---|
| 23 | 23 | | Governor. |
|---|
| 24 | 24 | | SECTION 2. The following temporary provision is added to |
|---|
| 25 | 25 | | the Texas Constitution: |
|---|
| 26 | 26 | | TEMPORARY PROVISION. (a) This temporary provision applies |
|---|
| 27 | 27 | | to the constitutional amendment proposed by the 89th Legislature, |
|---|
| 28 | 28 | | Regular Session, 2025, relating to requiring that future |
|---|
| 29 | 29 | | constitutional amendments become effective only if approved by a |
|---|
| 30 | 30 | | majority of the voters in at least three-fourths of the counties of |
|---|
| 31 | 31 | | the state. |
|---|
| 32 | 32 | | (b) The amendment to Section 1(c), Article XVII, of this |
|---|
| 33 | 33 | | constitution takes effect January 1, 2026. |
|---|
| 34 | 34 | | (c) This temporary provision expires January 1, 2027, and |
|---|
| 35 | 35 | | applies only to another proposed constitutional amendment for which |
|---|
| 36 | 36 | | the election to approve the amendment is held on or after that date. |
|---|
| 37 | 37 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 38 | 38 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 39 | 39 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 40 | 40 | | proposition: "The constitutional amendment to require that future |
|---|
| 41 | 41 | | constitutional amendments become effective only if approved by a |
|---|
| 42 | 42 | | majority of the voters in at least three-fourths of the counties of |
|---|
| 43 | 43 | | the state." |
|---|
