| 8 | 8 | | proposing a constitutional amendment requiring the board members of |

| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 49-c(a), Article III, Texas |
|---|
| 13 | 13 | | Constitution, is amended to read as follows: |
|---|
| 14 | 14 | | (a) The Texas Water Development Board, an agency of the |
|---|
| 15 | 15 | | State of Texas, shall exercise such powers as necessary under this |
|---|
| 16 | 16 | | provision together with such other duties and restrictions as may |
|---|
| 17 | 17 | | be prescribed by law. The qualifications, compensation, and number |
|---|
| 18 | 18 | | of members of said Board shall be determined by law. They shall be |
|---|
| 19 | 19 | | chosen by the qualified voters at a general election [appointed by |
|---|
| 20 | 20 | | the Governor with the advice and consent of the Senate] in the |
|---|
| 21 | 21 | | manner and for such terms as may be prescribed by law. |
|---|
| 22 | 22 | | SECTION 2. The following temporary provision is added to |
|---|
| 23 | 23 | | the Texas Constitution: |
|---|
| 24 | 24 | | TEMPORARY PROVISION. (a) This temporary provision applies |
|---|
| 25 | 25 | | to the constitutional amendment proposed by the 89th Legislature, |
|---|
| 26 | 26 | | Regular Session, 2025, requiring the board members of the Texas |
|---|
| 27 | 27 | | Water Development Board to be elected by the qualified voters at a |
|---|
| 28 | 28 | | general election instead of appointed by the governor. |
|---|
| 29 | 29 | | (b) Unless otherwise removed as provided by law, the board |
|---|
| 30 | 30 | | members of the Texas Water Development Board serving on the date |
|---|
| 31 | 31 | | that the adoption of the amendment by the voters is shown by the |
|---|
| 32 | 32 | | official canvass of returns shall continue in office under the |
|---|
| 33 | 33 | | former law, and that former law is continued in effect for that |
|---|
| 34 | 34 | | purpose. |
|---|
| 35 | 35 | | (c) This temporary provision expires January 1, 2030. |

| 36 | 36 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 37 | 37 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 38 | 38 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 39 | 39 | | proposition: "The constitutional amendment requiring the board |
|---|
| 40 | 40 | | members of the Texas Water Development Board to be elected by the |
|---|
| 41 | 41 | | qualified voters at a general election instead of appointed by the |
|---|
| 42 | 42 | | governor." |
