77 A JOINT RESOLUTION
88 proposing a constitutional amendment requiring the board members of
99 the Texas Water Development Board to be elected by the qualified
1010 voters at a general election instead of appointed by the governor.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 49-c(a), Article III, Texas
1313 Constitution, is amended to read as follows:
1414 (a) The Texas Water Development Board, an agency of the
1515 State of Texas, shall exercise such powers as necessary under this
1616 provision together with such other duties and restrictions as may
1717 be prescribed by law. The qualifications, compensation, and number
1818 of members of said Board shall be determined by law. They shall be
1919 chosen by the qualified voters at a general election [appointed by
2020 the Governor with the advice and consent of the Senate] in the
2121 manner and for such terms as may be prescribed by law.
2222 SECTION 2. The following temporary provision is added to
2323 the Texas Constitution:
2424 TEMPORARY PROVISION. (a) This temporary provision applies
2525 to the constitutional amendment proposed by the 89th Legislature,
2626 Regular Session, 2025, requiring the board members of the Texas
2727 Water Development Board to be elected by the qualified voters at a
2828 general election instead of appointed by the governor.
2929 (b) Unless otherwise removed as provided by law, the board
3030 members of the Texas Water Development Board serving on the date
3131 that the adoption of the amendment by the voters is shown by the
3232 official canvass of returns shall continue in office under the
3333 former law, and that former law is continued in effect for that
3434 purpose.
3535 (c) This temporary provision expires January 1, 2030.
3636 SECTION 3. This proposed constitutional amendment shall be
3737 submitted to the voters at an election to be held November 4, 2025.
3838 The ballot shall be printed to provide for voting for or against the
3939 proposition: "The constitutional amendment requiring the board
4040 members of the Texas Water Development Board to be elected by the
4141 qualified voters at a general election instead of appointed by the
4242 governor."
