46 A JOINT RESOLUTION
57 proposing a constitutional amendment, to be submitted to the voters
68 of Texas for approval, authorizing the legislature to strictly
79 regulate and authorize casino gaming and sports wagering by general
810 law and establishing certain requirements for such law, including
911 imposition of a tax on casino gaming and sports wagering revenue,
1012 requiring licensing of casino gaming and sports wagering operators,
1113 and requiring license application fees.
1214 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1315 SECTION 1. Section 47, Article III, Texas Constitution, is
1416 amended by amending Subsection (a) and adding Subsection (f) to
1517 read as follows:
1618 (a) The Legislature shall pass laws prohibiting lotteries
1719 and gift enterprises in this State other than those authorized by
1820 Subsections (b), (d), (d-1), [and] (e), and (f) of this section.
1921 (f) The Legislature by general law may authorize and
2022 strictly regulate casino gaming and sports wagering. At a minimum,
2123 the law must:
2224 (1) define the activities that constitute casino
2325 gaming and sports wagering;
2426 (2) require licenses and license application fees for
2527 casino gaming and sports wagering operators;
2628 (3) determine where licensed casino facilities may be
2729 located and where sports wagering may be conducted;
2830 (4) restrict the conduct of casino gaming, as defined
2931 by the Legislature, to onsite casino gaming at a licensed casino
3032 gaming operator's physical premises in this state;
3133 (5) limit the total number of casino gaming licenses
3234 and locations with initial license terms of at least 40 years to no
3335 more than 10 licensed facilities in this state;
3436 (6) impose a tax on casino gaming and sports wagering
3537 revenue not to exceed 15 percent;
3638 (7) prohibit the imposition of any additional tax or
3739 fee by the state or political subdivision of the state on casino
3840 gaming revenue or sports wagering revenue, or on the
3941 non-casino-gaming revenue or non-sports-wagering revenue of a
4042 license holder's operations, other than a tax or fee generally
4143 applicable to a business operating in this state; and
4244 (8) establish a process for this state to negotiate in
4345 good faith and execute in a timely manner, a Tribal-State gaming
4446 compact with any of the three existing federally recognized Indian
4547 tribes with Indian lands in this state to conduct Class III Indian
4648 gaming on a Tribe's existing lands, and as prescribed by the Indian
4749 Gaming Regulatory Act (Pub. L. 100-479), consistent with the
4850 provisions in 25 U.S.C. Section 2710(d), and upon the request of the
4951 tribe.
5052 SECTION 2. This proposed constitutional amendment shall be
5153 submitted to the voters at an election to be held November 3, 2025.
5254 The ballot shall be printed to permit voting for or against the
5355 proposition: "The constitutional amendment to permit the
5456 Legislature, by general law, to authorize and regulate casino
5557 gaming and sports wagering at a limited number of locations in this
5658 state, require licenses and license application fees for operators,
5759 and impose a tax on casino gaming and sports wagering revenue."
