77 A JOINT RESOLUTION
88 proposing a constitutional amendment abolishing the automatic
99 resignation of certain municipal, county, or district
1010 officeholders if they become candidates for another office.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11(a), Article XI, Texas Constitution,
1313 is amended to read as follows:
1414 (a) A Home Rule City may provide by charter or charter
1515 amendment, and a city, town or village operating under the general
1616 laws may provide by majority vote of the qualified voters voting at
1717 an election called for that purpose, for a longer term of office
1818 than two (2) years for its officers, either elective or appointive,
1919 or both, but not to exceed four (4) years; provided, however, that
2020 tenure under Civil Service shall not be affected hereby[; provided,
2121 however, that such officers, elective or appointive, are subject to
2222 Section 65(b), Article XVI, of this constitution, providing for
2323 automatic resignation in certain circumstances, in the same manner
2424 as a county or district officer to which that section applies].
2525 SECTION 2. Section 65, Article XVI, Texas Constitution, is
2626 repealed.
2727 SECTION 3. This proposed constitutional amendment shall be
2828 submitted to the voters at an election to be held November 4, 2025.
2929 The ballot shall be printed to provide for voting for or against the
3030 proposition: "The constitutional amendment abolishing the
3131 automatic resignation of certain municipal, county, or district
3232 officeholders if they become candidates for another office."
