77 A JOINT RESOLUTION
88 proposing a constitutional amendment requiring the denial of bail
99 for an illegal alien charged with an offense punishable as a felony.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article I, Texas Constitution, is amended by
1212 adding Section 11e to read as follows:
1313 Sec. 11e. (a) In this section, "illegal alien" means a
1414 person who:
1515 (1) entered the United States without inspection or at
1616 any time or place other than as designated by the United States
1717 attorney general; or
1818 (2) was admitted as a nonimmigrant and, before the
1919 date of the commission of the offense, had failed to maintain the
2020 nonimmigrant status under which the alien was admitted or to which
2121 the status was changed under applicable federal immigration law, or
2222 to comply with the conditions of the person's status.
2323 (b) An illegal alien who is accused of committing an offense
2424 punishable as a felony shall be denied bail pending trial if a judge
2525 or magistrate determines after a hearing that probable cause exists
2626 to believe that the person engaged in the conduct constituting the
2727 offense.
2828 SECTION 2. This proposed constitutional amendment shall be
2929 submitted to the voters at an election to be held November 4, 2025.
3030 The ballot shall be printed to permit voting for or against the
3131 proposition: "The constitutional amendment requiring the denial of
3232 bail for an illegal alien charged with an offense punishable as a
3333 felony."
