7	7	A JOINT RESOLUTION
8	8	proposing a constitutional amendment to include the United States
9	9	Space Force in references to military service in the state
10	10	constitution.
11	11	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 40(a), Article XVI, Texas Constitution,
13	13	is amended to read as follows:
14	14	(a) No person shall hold or exercise at the same time, more
15	15	than one civil office of emolument, except that of Justice of the
16	16	Peace, County Commissioner, Notary Public and Postmaster, Officer
17	17	of the National Guard, the National Guard Reserve, and the Officers
18	18	Reserve Corps of the United States and enlisted men of the National
19	19	Guard, the National Guard Reserve, and the Organized Reserves of
20	20	the United States, and retired officers of the United States Army,
21	21	Air Force, Space Force, Navy, Marine Corps, and Coast Guard, and
22	22	retired warrant officers, and retired enlisted men of the United
23	23	States Army, Air Force, Space Force, Navy, Marine Corps, and Coast
24	24	Guard, and officers and enlisted members of the Texas State Guard
25	25	and any other active militia or military force organized under
26	26	state law, and the officers and directors of soil and water
27	27	conservation districts, unless otherwise specially provided
28	28	herein. Provided, that nothing in this Constitution shall be
29	29	construed to prohibit an officer or enlisted man of the National
30	30	Guard, the National Guard Reserve, the Texas State Guard, and any
31	31	other active militia or military force organized under state law,
32	32	or an officer in the Officers Reserve Corps of the United States, or
33	33	an enlisted man in the Organized Reserves of the United States, or
34	34	retired officers of the United States Army, Air Force, Space Force,
35	35	Navy, Marine Corps, and Coast Guard, and retired warrant officers,
36	36	and retired enlisted men of the United States Army, Air Force, Space
37	37	Force, Navy, Marine Corps, and Coast Guard, and officers of the
38	38	State soil and water conservation districts, from holding at the
39	39	same time any other office or position of honor, trust or profit,
40	40	under this State or the United States, or from voting at any
41	41	election, general, special or primary in this State when otherwise
42	42	qualified.
43	43	SECTION 2. Section 72(h), Article XVI, Texas Constitution,
44	44	is amended to read as follows:
45	45	(h) In this section, "armed forces of the United States"
46	46	means the United States Army, the United States Navy, the United
47	47	States Air Force, the United States Space Force, the United States
48	48	Marine Corps, the United States Coast Guard, any reserve or
49	49	auxiliary component of any of those services, or the National
50	50	Guard.
51	51	SECTION 3. This proposed constitutional amendment shall be
52	52	submitted to the voters at an election to be held November 4, 2025.
53	53	The ballot shall be printed to permit voting for or against the
54	54	proposition: "The constitutional amendment to include the United
55	55	States Space Force in references to military service in the state
56	56	constitution."
