77 A JOINT RESOLUTION
88 proposing a constitutional amendment to include the United States
99 Space Force in references to military service in the state
1010 constitution.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 40(a), Article XVI, Texas Constitution,
1313 is amended to read as follows:
1414 (a) No person shall hold or exercise at the same time, more
1515 than one civil office of emolument, except that of Justice of the
1616 Peace, County Commissioner, Notary Public and Postmaster, Officer
1717 of the National Guard, the National Guard Reserve, and the Officers
1818 Reserve Corps of the United States and enlisted men of the National
1919 Guard, the National Guard Reserve, and the Organized Reserves of
2020 the United States, and retired officers of the United States Army,
2121 Air Force, Space Force, Navy, Marine Corps, and Coast Guard, and
2222 retired warrant officers, and retired enlisted men of the United
2323 States Army, Air Force, Space Force, Navy, Marine Corps, and Coast
2424 Guard, and officers and enlisted members of the Texas State Guard
2525 and any other active militia or military force organized under
2626 state law, and the officers and directors of soil and water
2727 conservation districts, unless otherwise specially provided
2828 herein. Provided, that nothing in this Constitution shall be
2929 construed to prohibit an officer or enlisted man of the National
3030 Guard, the National Guard Reserve, the Texas State Guard, and any
3131 other active militia or military force organized under state law,
3232 or an officer in the Officers Reserve Corps of the United States, or
3333 an enlisted man in the Organized Reserves of the United States, or
3434 retired officers of the United States Army, Air Force, Space Force,
3535 Navy, Marine Corps, and Coast Guard, and retired warrant officers,
3636 and retired enlisted men of the United States Army, Air Force, Space
3737 Force, Navy, Marine Corps, and Coast Guard, and officers of the
3838 State soil and water conservation districts, from holding at the
3939 same time any other office or position of honor, trust or profit,
4040 under this State or the United States, or from voting at any
4141 election, general, special or primary in this State when otherwise
4242 qualified.
4343 SECTION 2. Section 72(h), Article XVI, Texas Constitution,
4444 is amended to read as follows:
4545 (h) In this section, "armed forces of the United States"
4646 means the United States Army, the United States Navy, the United
4747 States Air Force, the United States Space Force, the United States
4848 Marine Corps, the United States Coast Guard, any reserve or
4949 auxiliary component of any of those services, or the National
5050 Guard.
5151 SECTION 3. This proposed constitutional amendment shall be
5252 submitted to the voters at an election to be held November 4, 2025.
5353 The ballot shall be printed to permit voting for or against the
5454 proposition: "The constitutional amendment to include the United
5555 States Space Force in references to military service in the state
5656 constitution."
