97 A JOINT RESOLUTION
108 proposing a constitutional amendment relating to the right to own,
119 hold, and use a mutually agreed upon medium of exchange.
1210 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Article I, Texas Constitution, is amended by
1412 adding Section 37 to read as follows:
1513 Sec. 37. The right of the people to own, hold, and use a
1614 mutually agreed upon medium of exchange, including cash, coin,
1715 bullion, digital currency, or privately issued scrip, when trading
1816 and contracting for goods and services shall not be infringed. No
1917 government shall prohibit or encumber the ownership or holding of
2018 any form or amount of money or other currency. Nothing in this
2119 section shall be construed as restricting this state from choosing
2220 the medium of exchange the state will accept for payments made to
2321 the state.
2422 SECTION 2. This proposed constitutional amendment shall be
2523 submitted to the voters at an election to be held November 4, 2025.
2624 The ballot shall be printed to permit voting for or against the
2725 proposition: "The constitutional amendment recognizing the right
2826 of the people to own, hold, and use a mutually agreed upon medium of
2927 exchange, including cash, coin, bullion, digital currency, or
3028 privately issued scrip."
