77 A JOINT RESOLUTION
88 proposing a constitutional amendment specifying the authority of
99 the attorney general to prosecute a criminal offense prescribed by
1010 the election laws of this state.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 22, Article IV, Texas Constitution, is
1313 amended to read as follows:
1414 Sec. 22. (a) The Attorney General shall represent the State
1515 in all suits and pleas in the Supreme Court of the State in which the
1616 State may be a party, and shall especially inquire into the charter
1717 rights of all private corporations, and from time to time, in the
1818 name of the State, take such action in the courts as may be proper
1919 and necessary to prevent any private corporation from exercising
2020 any power or demanding or collecting any species of taxes, tolls,
2121 freight or wharfage not authorized by law. The Attorney General
2222 [He] shall, whenever sufficient cause exists, seek a judicial
2323 forfeiture of such charters, unless otherwise expressly directed by
2424 law, and give legal advice in writing to the Governor and other
2525 executive officers, when requested by them, and perform such other
2626 duties as may be required by law.
2727 (b) The Attorney General shall have concurrent jurisdiction
2828 with each county or district attorney of this State to represent
2929 this State in the prosecution of a criminal offense prescribed by
3030 the election laws of this State.
3131 SECTION 2. This proposed constitutional amendment shall be
3232 submitted to the voters at an election to be held November 4, 2025.
3333 The ballot shall be printed to provide for voting for or against the
3434 proposition: "The constitutional amendment specifying the
3535 authority of the attorney general to prosecute a criminal offense
3636 prescribed by the election laws of this state."
