10 | 10 | | trustees of a school district who becomes a candidate for the |

11 | 11 | | legislature or the United States Congress. |

12 | 12 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Section 11, Article XI, Texas Constitution, is |
---|
14 | 14 | | amended by adding Subsection (a-1) to read as follows: |
---|
15 | 15 | | (a-1) A city council member serving any length of term of |
---|
16 | 16 | | office is subject to Section 65(b), Article XVI, of this |
---|
17 | 17 | | constitution, in the same manner as a county or district officer to |
---|
18 | 18 | | which that section applies, if the member announces the member's |
---|
19 | 19 | | candidacy in an election for the Texas Senate, Texas House of |
---|
20 | 20 | | Representatives, or United States Congress. |
---|
21 | 21 | | SECTION 2. Section 65, Article XVI, Texas Constitution, is |
---|
22 | 22 | | amended to read as follows: |
---|
23 | 23 | | Sec. 65. (a) This section applies to the following |
---|
24 | 24 | | offices: District Clerks; County Clerks; County Judges; Judges of |
---|
25 | 25 | | the County Courts at Law, County Criminal Courts, County Probate |
---|
26 | 26 | | Courts and County Domestic Relations Courts; County Treasurers; |
---|
27 | 27 | | Criminal District Attorneys; County Surveyors; County |
---|
28 | 28 | | Commissioners; Justices of the Peace; Sheriffs; Assessors and |
---|
29 | 29 | | Collectors of Taxes; District Attorneys; County Attorneys; Public |
---|
30 | 30 | | Weighers; [and] Constables; and Members of the Board of Trustees of |
---|
31 | 31 | | a School District. |
---|
32 | 32 | | (b) Except as provided by Subsection (c) of this section, if |
---|
33 | 33 | | [If] any of the officers named herein shall announce their |
---|
34 | 34 | | candidacy, or shall in fact become a candidate, in any General, |
---|
35 | 35 | | Special or Primary Election, for any office of profit or trust under |
---|
36 | 36 | | the laws of this State or the United States other than the office |
---|
37 | 37 | | then held, at any time when the unexpired term of the office then |
---|
38 | 38 | | held shall exceed one year and 30 days, such announcement or such |
---|
39 | 39 | | candidacy shall constitute an automatic resignation of the office |
---|
40 | 40 | | then held, and the vacancy thereby created shall be filled pursuant |
---|
41 | 41 | | to law in the same manner as other vacancies for such office are |
---|
42 | 42 | | filled. |
---|
43 | 43 | | (c) A member of the board of trustees of a school district is |
---|
44 | 44 | | only subject to Subsection (b) of this section if the member |
---|
45 | 45 | | announces the member's candidacy in an election for the Texas |
---|
46 | 46 | | Senate, Texas House of Representatives, or United States Congress. |
---|
47 | 47 | | SECTION 3. This proposed constitutional amendment shall be |
---|
48 | 48 | | submitted to the voters at an election to be held November 4, 2025. |
---|
49 | 49 | | The ballot shall be printed to provide for voting for or against the |
---|
50 | 50 | | proposition: "The constitutional amendment requiring automatic |
---|
51 | 51 | | resignation of a city council member or member of the board of |
---|
52 | 52 | | trustees of a school district who becomes a candidate for the |
---|
53 | 53 | | legislature or the United States Congress." |
---|
