77 A JOINT RESOLUTION
88 proposing a constitutional amendment requiring automatic
99 resignation of a city council member or member of the board of
1010 trustees of a school district who becomes a candidate for the
1111 legislature or the United States Congress.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 11, Article XI, Texas Constitution, is
1414 amended by adding Subsection (a-1) to read as follows:
1515 (a-1) A city council member serving any length of term of
1616 office is subject to Section 65(b), Article XVI, of this
1717 constitution, in the same manner as a county or district officer to
1818 which that section applies, if the member announces the member's
1919 candidacy in an election for the Texas Senate, Texas House of
2020 Representatives, or United States Congress.
2121 SECTION 2. Section 65, Article XVI, Texas Constitution, is
2222 amended to read as follows:
2323 Sec. 65. (a) This section applies to the following
2424 offices: District Clerks; County Clerks; County Judges; Judges of
2525 the County Courts at Law, County Criminal Courts, County Probate
2626 Courts and County Domestic Relations Courts; County Treasurers;
2727 Criminal District Attorneys; County Surveyors; County
2828 Commissioners; Justices of the Peace; Sheriffs; Assessors and
2929 Collectors of Taxes; District Attorneys; County Attorneys; Public
3030 Weighers; [and] Constables; and Members of the Board of Trustees of
3131 a School District.
3232 (b) Except as provided by Subsection (c) of this section, if
3333 [If] any of the officers named herein shall announce their
3434 candidacy, or shall in fact become a candidate, in any General,
3535 Special or Primary Election, for any office of profit or trust under
3636 the laws of this State or the United States other than the office
3737 then held, at any time when the unexpired term of the office then
3838 held shall exceed one year and 30 days, such announcement or such
3939 candidacy shall constitute an automatic resignation of the office
4040 then held, and the vacancy thereby created shall be filled pursuant
4141 to law in the same manner as other vacancies for such office are
4242 filled.
4343 (c) A member of the board of trustees of a school district is
4444 only subject to Subsection (b) of this section if the member
4545 announces the member's candidacy in an election for the Texas
4646 Senate, Texas House of Representatives, or United States Congress.
4747 SECTION 3. This proposed constitutional amendment shall be
4848 submitted to the voters at an election to be held November 4, 2025.
4949 The ballot shall be printed to provide for voting for or against the
5050 proposition: "The constitutional amendment requiring automatic
5151 resignation of a city council member or member of the board of
5252 trustees of a school district who becomes a candidate for the
5353 legislature or the United States Congress."
