11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Article VII, Texas Constitution, is amended by |
---|
13 | 13 | | adding Section 8a to read as follows: |
---|
14 | 14 | | Sec. 8a. (a) The legislature may not enact a law that |
---|
15 | 15 | | requires a school district to comply with an unfunded or |
---|
16 | 16 | | underfunded mandate that establishes, expands, or modifies a duty |
---|
17 | 17 | | or activity of the school district and requires an expenditure of |
---|
18 | 18 | | revenue by the school district, unless the legislature appropriates |
---|
19 | 19 | | or otherwise provides, from a source other than the revenue of the |
---|
20 | 20 | | school district, for the payment or reimbursement of the costs |
---|
21 | 21 | | incurred by the school district in complying with the mandate. |
---|
22 | 22 | | (b) Any proposed legislation that requires an expenditure |
---|
23 | 23 | | of revenue by a school district to comply with a mandate must |
---|
24 | 24 | | include a detailed fiscal impact statement estimating the projected |
---|
25 | 25 | | cost to each school district affected by the proposed legislation. |

26 | 26 | | SECTION 2. This proposed constitutional amendment shall be |
---|
27 | 27 | | submitted to the voters at an election to be held November 4, 2025. |
---|
28 | 28 | | The ballot shall be printed to permit voting for or against the |
---|
29 | 29 | | proposition: "The constitutional amendment to restrict the power |
---|
30 | 30 | | of the legislature to mandate unfunded or underfunded costs and |
---|
31 | 31 | | requirements on a school district." |
