77 A JOINT RESOLUTION
88 proposing a constitutional amendment to restrict the power of the
99 legislature to mandate unfunded or underfunded costs and
1010 requirements on a school district.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article VII, Texas Constitution, is amended by
1313 adding Section 8a to read as follows:
1414 Sec. 8a. (a) The legislature may not enact a law that
1515 requires a school district to comply with an unfunded or
1616 underfunded mandate that establishes, expands, or modifies a duty
1717 or activity of the school district and requires an expenditure of
1818 revenue by the school district, unless the legislature appropriates
1919 or otherwise provides, from a source other than the revenue of the
2020 school district, for the payment or reimbursement of the costs
2121 incurred by the school district in complying with the mandate.
2222 (b) Any proposed legislation that requires an expenditure
2323 of revenue by a school district to comply with a mandate must
2424 include a detailed fiscal impact statement estimating the projected
2525 cost to each school district affected by the proposed legislation.
2626 SECTION 2. This proposed constitutional amendment shall be
2727 submitted to the voters at an election to be held November 4, 2025.
2828 The ballot shall be printed to permit voting for or against the
2929 proposition: "The constitutional amendment to restrict the power
3030 of the legislature to mandate unfunded or underfunded costs and
3131 requirements on a school district."
