77 A JOINT RESOLUTION
88 proposing a constitutional amendment to authorize the legislature
99 to provide for a one-time credit against the ad valorem taxes
1010 imposed by a political subdivision on the first property that a
1111 person purchases and qualifies as the person's residence homestead
1212 and to provide for the reimbursement of political subdivisions for
1313 the revenue loss incurred as a result of the credit.
1414 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Article VIII, Texas Constitution, is amended by
1616 adding Section 1-q to read as follows:
1717 Sec. 1-q. (a) The legislature by general law may provide
1818 that a person who purchases a home is entitled to a one-time credit
1919 against the ad valorem taxes imposed by a political subdivision on
2020 the home in the first tax year in which the property qualifies as
2121 the person's residence homestead if the person has not previously
2222 qualified a property as the person's residence homestead. The
2323 amount of the credit may not exceed the lesser of:
2424 (1) the amount computed by multiplying $3,000 by a
2525 fraction, the numerator of which is the amount of taxes imposed on
2626 the residence homestead by the political subdivision and the
2727 denominator of which is the total amount of taxes imposed on the
2828 residence homestead by all of the political subdivisions that
2929 impose taxes on the residence homestead; or
3030 (2) one-half of the amount of taxes imposed by the
3131 political subdivision on the residence homestead.
3232 (b) The legislature may prescribe additional eligibility
3333 requirements for receiving a credit under this section.
3434 (c) Notwithstanding any other provision of this
3535 constitution, the legislature by general law may authorize the use
3636 of state money to reimburse a political subdivision for the revenue
3737 loss incurred by the political subdivision as a result of the tax
3838 credit authorized by this section and shall provide a procedure for
3939 distributing any money appropriated for that purpose.
4040 SECTION 2. This proposed constitutional amendment shall be
4141 submitted to the voters at an election to be held November 4, 2025.
4242 The ballot shall be printed to permit voting for or against the
4343 proposition: "The constitutional amendment to authorize the
4444 legislature to provide for a one-time credit against the ad valorem
4545 taxes imposed by a political subdivision on the first property that
4646 a person purchases and qualifies as the person's residence
4747 homestead and to provide for the reimbursement of political
4848 subdivisions for the revenue loss incurred as a result of the
4949 credit."
