77 A JOINT RESOLUTION
88 proposing a constitutional amendment requiring the state to expand
99 eligibility for Medicaid to certain individuals under the federal
1010 Patient Protection and Affordable Care Act.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article XVI, Texas Constitution, is amended by
1313 adding Section 74 to read as follows:
1414 Sec. 74. The state shall provide medical assistance to all
1515 individuals who apply for that assistance and for whom federal
1616 matching funds are available under the Patient Protection and
1717 Affordable Care Act (Pub. L. No. 111-148), as amended by the Health
1818 Care and Education Reconciliation Act of 2010 (Pub. L. No.
1919 111-152), to the state to provide that assistance.
2020 SECTION 2. The following temporary provision is added to
2121 the Texas Constitution:
2222 TEMPORARY PROVISION. (a) This temporary provision applies
2323 to the constitutional amendment proposed by the 89th Legislature,
2424 Regular Session, 2025, requiring the state to expand eligibility
2525 for Medicaid to all individuals for whom federal matching funds are
2626 available under the federal Patient Protection and Affordable Care
2727 Act.
2828 (b) Section 74, Article XVI, of this constitution takes
2929 effect January 1, 2026.
3030 (c) This temporary provision expires January 1, 2027.
3131 SECTION 3. This proposed constitutional amendment shall be
3232 submitted to the voters at an election to be held November 4, 2025.
3333 The ballot shall be printed to provide for voting for or against the
3434 proposition: "The constitutional amendment requiring the state to
3535 expand eligibility for Medicaid to all individuals for whom federal
3636 matching funds are available under the federal Patient Protection
3737 and Affordable Care Act."
