| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 5, Article XV, Texas Constitution, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 5. (a) All officers against whom articles of |
|---|
| 15 | 15 | | impeachment may be preferred shall be suspended from the exercise |
|---|
| 16 | 16 | | of the duties of their offices [office], with ordinary pay, during |
|---|
| 17 | 17 | | the pendency of such impeachment. |
|---|
| 18 | 18 | | (b) The Governor may make a provisional appointment to fill |
|---|
| 19 | 19 | | the vacancy[,] occasioned by the suspension of an officer, other |
|---|
| 20 | 20 | | than the Governor, until the decision on the impeachment. |
|---|
| 21 | 21 | | (c) Section 16, Article IV, of this Constitution applies to |
|---|
| 22 | 22 | | a vacancy occasioned by the suspension of the Governor on |
|---|
| 23 | 23 | | impeachment or by the removal of the Governor from office. |
|---|
| 24 | 24 | | SECTION 2. Section 7, Article XV, Texas Constitution, is |
|---|
| 25 | 25 | | amended to read as follows: |
|---|
| 26 | 26 | | Sec. 7. (a) The Legislature shall provide by law for the |
|---|
| 27 | 27 | | trial and removal from office of all officers of this State, the |
|---|
| 28 | 28 | | modes for which have not been provided in this Constitution. |
|---|
| 29 | 29 | | (b) The Legislature may enact general laws, consistent with |
|---|
| 30 | 30 | | this Constitution, to implement this Article or another provision |
|---|
| 31 | 31 | | of this Constitution providing for the impeachment, trial, removal |
|---|
| 32 | 32 | | from office, or disqualification of an officer of this State. |
|---|
| 33 | 33 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 34 | 34 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 35 | 35 | | The ballot shall be printed to permit voting for or against the |
|---|
| 36 | 36 | | proposition: "The constitutional amendment clarifying and |
|---|
| 37 | 37 | | implementing certain provisions governing the impeachment, trial, |
|---|
| 38 | 38 | | removal from office, and disqualification of public officers." |
