77 A JOINT RESOLUTION
88 proposing a constitutional amendment allowing a member of the
99 legislature to be employed as a teacher or first responder by a
1010 governmental entity while holding legislative office.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 40(d), Article XVI, Texas Constitution,
1313 is amended to read as follows:
1414 (d) No member of the Legislature of this State may hold any
1515 other office or position of profit under this State, or the United
1616 States, except as:
1717 (1) a notary public if qualified by law;
1818 (2) a schoolteacher; or
1919 (3) a person who serves as a first responder in one or
2020 more of the following capacities:
2121 (A) public health and public safety personnel;
2222 (B) commissioned law enforcement personnel;
2323 (C) fire protection personnel;
2424 (D) emergency medical services personnel,
2525 including hospital emergency facility staff;
2626 (E) a member of the National Guard; or
2727 (F) a member of the Texas State Guard.
2828 SECTION 2. This proposed constitutional amendment shall be
2929 submitted to the voters at an election to be held November 4, 2025.
3030 The ballot shall be printed to provide for voting for or against the
3131 proposition: "The constitutional amendment allowing a member of the
3232 legislature to be employed as a teacher or first responder by a
3333 governmental entity while holding legislative office."
