| 8 | 8 | | proposing a constitutional amendment allowing a member of the |

| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 40(d), Article XVI, Texas Constitution, |
|---|
| 13 | 13 | | is amended to read as follows: |
|---|
| 14 | 14 | | (d) No member of the Legislature of this State may hold any |
|---|
| 15 | 15 | | other office or position of profit under this State, or the United |
|---|
| 16 | 16 | | States, except as: |
|---|
| 17 | 17 | | (1) a notary public if qualified by law; |
|---|
| 18 | 18 | | (2) a schoolteacher; or |
|---|
| 19 | 19 | | (3) a person who serves as a first responder in one or |
|---|
| 20 | 20 | | more of the following capacities: |
|---|
| 21 | 21 | | (A) public health and public safety personnel; |
|---|
| 22 | 22 | | (B) commissioned law enforcement personnel; |
|---|
| 23 | 23 | | (C) fire protection personnel; |
|---|
| 24 | 24 | | (D) emergency medical services personnel, |
|---|
| 25 | 25 | | including hospital emergency facility staff; |
|---|
| 26 | 26 | | (E) a member of the National Guard; or |
|---|
| 27 | 27 | | (F) a member of the Texas State Guard. |

| 28 | 28 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 30 | 30 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 31 | 31 | | proposition: "The constitutional amendment allowing a member of the |
|---|
| 32 | 32 | | legislature to be employed as a teacher or first responder by a |
|---|
| 33 | 33 | | governmental entity while holding legislative office." |
