4	6		A JOINT RESOLUTION
5	7		proposing a constitutional amendment to authorize the use of money
6	8		from the Texas energy fund for energy efficiency projects conducted
7	9		to benefit retail electric customers.
8	10		BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Section 49-q(b), Article III, Texas
10	12		Constitution, is amended to read as follows:
11	13		(b) As provided by general law, money in the Texas energy
12	14		fund may be administered and used, without further appropriation,
13	15		only by the Public Utility Commission of Texas or that commission's
14	16		successor in function to provide loans and grants to any entity to
15	17		finance or incentivize the construction, maintenance,
16	18		modernization, and operation of electric generating facilities,
17	19		including associated infrastructure, necessary to ensure the
18	20		reliability or adequacy of an electric power grid in this state and
19	21		to finance energy efficiency projects conducted to benefit retail
20	22		electric customers. The commission shall allocate money from the
21	23		fund for loans and grants to eligible projects:
22	24		(1) for electric generating facilities that serve as
23	25		backup power sources; and
24	26		(2) in each region of the state that is part of an
25	27		electric power grid in proportion to that region's load share.
26	28		SECTION 2. This proposed constitutional amendment shall be
27	29		submitted to the voters at an election to be held November 4, 2025.
28	30		The ballot shall be printed to permit voting for or against the
29	31		proposition: "The constitutional amendment to authorize the use of
30	32		money from the Texas energy fund for energy efficiency projects
31	33		conducted to benefit retail electric customers."
