810 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 49-q(b), Article III, Texas
1012 Constitution, is amended to read as follows:
1113 (b) As provided by general law, money in the Texas energy
1214 fund may be administered and used, without further appropriation,
1315 only by the Public Utility Commission of Texas or that commission's
1416 successor in function to provide loans and grants to any entity to
1517 finance or incentivize the construction, maintenance,
1618 modernization, and operation of electric generating facilities,
1719 including associated infrastructure, necessary to ensure the
1820 reliability or adequacy of an electric power grid in this state and
1921 to finance energy efficiency projects conducted to benefit retail
2022 electric customers. The commission shall allocate money from the
2123 fund for loans and grants to eligible projects:
2224 (1) for electric generating facilities that serve as
2325 backup power sources; and
2426 (2) in each region of the state that is part of an
2527 electric power grid in proportion to that region's load share.
2628 SECTION 2. This proposed constitutional amendment shall be
2729 submitted to the voters at an election to be held November 4, 2025.
2830 The ballot shall be printed to permit voting for or against the
2931 proposition: "The constitutional amendment to authorize the use of
3032 money from the Texas energy fund for energy efficiency projects
3133 conducted to benefit retail electric customers."
