77 A JOINT RESOLUTION
88 proposing a constitutional amendment dedicating certain general
99 revenue that would otherwise be transferred to the economic
1010 stabilization fund to reducing school district maintenance and
1111 operations ad valorem taxes.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 49-g, Article III, Texas Constitution,
1414 is amended by adding Subsections (g-1) and (g-2) and amending
1515 Subsection (h) to read as follows:
1616 (g-1) When the comptroller of public accounts acts to
1717 prevent the amount in the economic stabilization fund from
1818 exceeding the limit in effect for a biennium under Subsection (g) of
1919 this section by reducing an amount transferred to the fund from
2020 general revenue as provided by Subsection (b) or (c) of this section
2121 or by crediting to general revenue interest that is due to the fund
2222 as provided by Subsection (i) of this section, the comptroller
2323 shall:
2424 (1) determine an amount of general revenue equal to
2525 the amount by which the balance of general revenue is increased by
2626 the reduction of the transfer from general revenue or the crediting
2727 of interest to general revenue; and
2828 (2) transfer the amount determined under Subdivision
2929 (1) of this subsection to the property tax relief fund or a
3030 successor fund or account the primary purpose of which is to reduce
3131 school district maintenance and operations ad valorem taxes.
3232 (g-2) Money transferred to the credit of the property tax
3333 relief fund or a successor fund or account under Subsection (g-1) of
3434 this section may be appropriated only for the purpose of reducing
3535 school district maintenance and operations ad valorem taxes as
3636 provided by general law.
3737 (h) In preparing an estimate of anticipated revenues for a
3838 succeeding biennium as required by Section 49a, Article III,
3939 [Section 49a,] of this constitution, the comptroller shall estimate
4040 the amount of the transfers that will be made under Subsections (b),
4141 (d), [and] (e), and (g-1) of this section. The comptroller shall
4242 deduct that amount from the estimate of anticipated revenues as if
4343 the transfers were made on August 31 of that fiscal year.
4444 SECTION 2. The following temporary provision is added to
4545 the Texas Constitution:
4646 TEMPORARY PROVISION. (a) This temporary provision applies
4747 to the constitutional amendment proposed by the 89th Legislature,
4848 Regular Session, 2025, dedicating certain general revenue that
4949 would otherwise be transferred to the economic stabilization fund
5050 to reducing school district maintenance and operations ad valorem
5151 taxes.
5252 (b) The amendments to Section 49-g, Article III, of this
5353 constitution take effect January 1, 2026.
5454 (c) This temporary provision expires January 1, 2027.
5555 SECTION 3. This proposed constitutional amendment shall be
5656 submitted to the voters at an election to be held November 4, 2025.
5757 The ballot shall be printed to permit voting for or against the
5858 proposition: "The constitutional amendment dedicating certain
5959 general revenue that would otherwise be transferred to the economic
6060 stabilization fund to reducing school district maintenance and
6161 operations ad valorem taxes."
