77 A JOINT RESOLUTION
88 proposing a constitutional amendment to permit additional uses of
99 certain dedicated general revenue transferred each fiscal year to
1010 the state highway fund.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 49-g(c), Article III, Texas
1313 Constitution, is amended to read as follows:
1414 (c) Not later than the 90th day of each fiscal year, the
1515 comptroller of public accounts shall transfer from the general
1616 revenue fund to the economic stabilization fund and the state
1717 highway fund the sum of the amounts described by Subsections (d) and
1818 (e) of this section, to be allocated as provided by Subsections
1919 (c-1) and (c-2) of this section. However, if necessary and
2020 notwithstanding the allocations prescribed by Subsections (c-1)
2121 and (c-2) of this section, the comptroller shall reduce
2222 proportionately the amounts described by Subsections (d) and (e) of
2323 this section to be transferred and allocated to the economic
2424 stabilization fund to prevent the amount in that fund from
2525 exceeding the limit in effect for that biennium under Subsection
2626 (g) of this section. Revenue transferred to the state highway fund
2727 under this subsection may be used only for constructing,
2828 maintaining, and acquiring rights-of-way for:
2929 (1) public roadways other than toll roads;
3030 (2) public transportation;
3131 (3) public bicycle paths; and
3232 (4) public sidewalks.
3333 SECTION 2. This proposed constitutional amendment shall be
3434 submitted to the voters at an election to be held November 4, 2025.
3535 The ballot shall be printed to permit voting for or against the
3636 proposition: "The constitutional amendment to permit additional
3737 uses of certain dedicated general revenue transferred each fiscal
3838 year to the state highway fund."
