77 A JOINT RESOLUTION
88 proposing a constitutional amendment allowing recovery of
99 exemplary damages by parents or a person's estate for a homicide.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 26, Article XVI, Texas Constitution, is
1212 amended to read as follows:
1313 Sec. 26. Every person, corporation, or company, that may
1414 commit a homicide, through wilful act, or omission, or gross
1515 neglect, shall be responsible, in exemplary damages, to the
1616 surviving spouse, children, or parents [husband, widow, heirs of
1717 his or her body], [or] such of them as there may be, or the deceased
1818 person's estate without regard to any criminal proceeding that may
1919 or may not be had in relation to the homicide.
2020 SECTION 2. This proposed constitutional amendment shall be
2121 submitted to the voters at an election to be held November 4, 2025.
2222 The ballot shall be printed to permit voting for or against the
2323 proposition: "The constitutional amendment allowing recovery of
2424 exemplary damages by parents or a person's estate for a homicide."
