| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 26, Article XVI, Texas Constitution, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 26. Every person, corporation, or company, that may |
|---|
| 14 | 14 | | commit a homicide, through wilful act, or omission, or gross |
|---|
| 15 | 15 | | neglect, shall be responsible, in exemplary damages, to the |
|---|
| 16 | 16 | | surviving spouse, children, or parents [husband, widow, heirs of |
|---|
| 17 | 17 | | his or her body], [or] such of them as there may be, or the deceased |
|---|
| 18 | 18 | | person's estate without regard to any criminal proceeding that may |
|---|
| 19 | 19 | | or may not be had in relation to the homicide. |
|---|
| 20 | 20 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 21 | 21 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 22 | 22 | | The ballot shall be printed to permit voting for or against the |
|---|
| 23 | 23 | | proposition: "The constitutional amendment allowing recovery of |
|---|
| 24 | 24 | | exemplary damages by parents or a person's estate for a homicide." |
