57 A JOINT RESOLUTION
68 proposing a constitutional amendment to dedicate a portion of the
79 revenue derived from state sales and use taxes to the Texas water
810 fund.
911 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Article VIII, Texas Constitution, is amended by
1113 adding Section 7-e to read as follows:
1214 Sec. 7-e. (a) Subject to Section 7-d of this article and
1315 Subsections (b) and (c) of this section, in each state fiscal year,
1416 the comptroller of public accounts shall deposit to the credit of
1517 the Texas water fund the net revenue derived from the imposition of
1618 the state sales and use tax on the sale, storage, use, or other
1719 consumption in this state of taxable items under Chapter 151, Tax
1820 Code, or its successor, that exceeds the first $48 billion of that
1921 revenue coming into the treasury in that state fiscal year,
2022 provided that the total amount deposited to the credit of the Texas
2123 water fund under this subsection in a state fiscal year may not
2224 exceed $1 billion.
2325 (b) The legislature by adoption of a concurrent resolution
2426 approved by a record vote of two-thirds of the members of each house
2527 of the legislature may direct the comptroller of public accounts to
2628 increase or reduce the amount of money deposited to the credit of
2729 the Texas water fund under Subsection (a) of this section. The
2830 comptroller may be directed to make the increase or reduction only:
2931 (1) in the state fiscal year in which the resolution is
3032 adopted, or in either of the following two state fiscal years; and
3133 (2) by an amount or percentage that does not result in:
3234 (A) an increase of more than 100 percent of the
3335 amount that would otherwise be deposited to the fund in the affected
3436 state fiscal year under Subsection (a) of this section; or
3537 (B) a reduction of more than 50 percent of the
3638 amount that would otherwise be deposited to the fund in the affected
3739 state fiscal year under Subsection (a) of this section.
3840 (c) Subject to Subsection (d) of this section, the duty of
3941 the comptroller of public accounts to make a deposit under this
4042 section expires August 31, 2035.
4143 (d) The legislature by adoption of a concurrent resolution
4244 approved by a record vote of a majority of the members of each house
4345 of the legislature may extend, in 10-year increments, the duty of
4446 the comptroller of public accounts to make a deposit under
4547 Subsection (a) of this section beyond the applicable date
4648 prescribed by Subsection (c) of this section.
4749 SECTION 2. The following temporary provision is added to
4850 the Texas Constitution:
4951 TEMPORARY PROVISION. (a) This temporary provision applies
5052 to the constitutional amendment proposed by the 89th Legislature,
5153 Regular Session, 2025, to dedicate a portion of the revenue derived
5254 from state sales and use taxes to the Texas water fund.
5355 (b) Section 7-e, Article VIII, of this constitution takes
5456 effect September 1, 2026.
5557 (c) This temporary provision expires September 1, 2027.
5658 SECTION 3. This proposed constitutional amendment shall be
5759 submitted to the voters at an election to be held November 4, 2025.
5860 The ballot shall be printed to permit voting for or against the
5961 proposition: "The constitutional amendment to dedicate a portion of
6062 the revenue derived from state sales and use taxes to the Texas
6163 water fund."
