5	7		A JOINT RESOLUTION
6	8		proposing a constitutional amendment to dedicate a portion of the
7	9		revenue derived from state sales and use taxes to the Texas water
8	10		fund.
9	11		BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Article VIII, Texas Constitution, is amended by
11	13		adding Section 7-e to read as follows:
12	14		Sec. 7-e. (a) Subject to Section 7-d of this article and
13	15		Subsections (b) and (c) of this section, in each state fiscal year,
14	16		the comptroller of public accounts shall deposit to the credit of
15	17		the Texas water fund the net revenue derived from the imposition of
16	18		the state sales and use tax on the sale, storage, use, or other
17	19		consumption in this state of taxable items under Chapter 151, Tax
18	20		Code, or its successor, that exceeds the first $48 billion of that
19	21		revenue coming into the treasury in that state fiscal year,
20	22		provided that the total amount deposited to the credit of the Texas
21	23		water fund under this subsection in a state fiscal year may not
22	24		exceed $1 billion.
23	25		(b) The legislature by adoption of a concurrent resolution
24	26		approved by a record vote of two-thirds of the members of each house
25	27		of the legislature may direct the comptroller of public accounts to
26	28		increase or reduce the amount of money deposited to the credit of
27	29		the Texas water fund under Subsection (a) of this section. The
28	30		comptroller may be directed to make the increase or reduction only:
29	31		(1) in the state fiscal year in which the resolution is
30	32		adopted, or in either of the following two state fiscal years; and
31	33		(2) by an amount or percentage that does not result in:
32	34		(A) an increase of more than 100 percent of the
33	35		amount that would otherwise be deposited to the fund in the affected
34	36		state fiscal year under Subsection (a) of this section; or
35	37		(B) a reduction of more than 50 percent of the
36	38		amount that would otherwise be deposited to the fund in the affected
37	39		state fiscal year under Subsection (a) of this section.
38	40		(c) Subject to Subsection (d) of this section, the duty of
39	41		the comptroller of public accounts to make a deposit under this
40	42		section expires August 31, 2035.
41	43		(d) The legislature by adoption of a concurrent resolution
42	44		approved by a record vote of a majority of the members of each house
43	45		of the legislature may extend, in 10-year increments, the duty of
44	46		the comptroller of public accounts to make a deposit under
45	47		Subsection (a) of this section beyond the applicable date
46	48		prescribed by Subsection (c) of this section.
47	49		SECTION 2. The following temporary provision is added to
48	50		the Texas Constitution:
49	51		TEMPORARY PROVISION. (a) This temporary provision applies
50	52		to the constitutional amendment proposed by the 89th Legislature,
51	53		Regular Session, 2025, to dedicate a portion of the revenue derived
52	54		from state sales and use taxes to the Texas water fund.
53	55		(b) Section 7-e, Article VIII, of this constitution takes
54	56		effect September 1, 2026.
55	57		(c) This temporary provision expires September 1, 2027.
56	58		SECTION 3. This proposed constitutional amendment shall be
57	59		submitted to the voters at an election to be held November 4, 2025.
58	60		The ballot shall be printed to permit voting for or against the
59	61		proposition: "The constitutional amendment to dedicate a portion of
60	62		the revenue derived from state sales and use taxes to the Texas
61	63		water fund."
