1211 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Article III, Texas Constitution, is amended by
1413 adding Section 49-r to read as follows:
1514 Sec. 49-r. (a) The Texas nuclear development fund is
1615 created as a special fund in the state treasury outside the general
1716 revenue fund.
1817 (b) As provided by general law, money in the Texas nuclear
1918 development fund may be administered and used, without further
20- appropriation, only by the Public Utility Commission of Texas or
21- that commission's successor in function to provide grants to any
22- entity, based on recommendations from the office of the governor,
23- to finance or incentivize the development, construction, and
24- operation of advanced nuclear reactor projects and associated
25- infrastructure as necessary to ensure a reliable and adequate
26- supply of electric power in this state.

2724 (c) The entity administering the Texas nuclear development
2825 fund may establish separate accounts in the fund as necessary or
2926 convenient for the fund's administration.
3027 (d) The Texas nuclear development fund consists of:
3128 (1) money credited, appropriated, or transferred to
3229 the fund by or as authorized by the legislature;
3330 (2) revenue that the legislature dedicates for deposit
3431 to the credit of the fund;
3532 (3) the returns received from the investment of the
36- money in the fund; and
33+ money in the fund or money in other funds and designated to the
34+ Texas nuclear development fund; and
3735 (4) gifts, grants, and donations contributed to the
3836 credit of the fund.
3937 (e) The reasonable expenses of managing the Texas nuclear
4038 development fund's assets shall be paid from the fund.
4139 (f) The legislature by a provision of a general
4240 appropriations act may provide for the transfer to the general
4341 revenue fund of money that is subject to this section.
4442 (g) The legislature may appropriate general revenue for the
4543 purpose of depositing money to the credit of the Texas nuclear
4644 development fund to be used for the purposes of that fund.
4745 (h) For purposes of Section 22, Article VIII, of this
4846 constitution:
4947 (1) money in the Texas nuclear development fund is
5048 dedicated by this constitution; and
5149 (2) an appropriation of state tax revenues for the
5250 purpose of depositing money to the credit of the Texas nuclear
5351 development fund is treated as if it were an appropriation of
5452 revenues dedicated by this constitution.
5553 SECTION 2. This proposed constitutional amendment shall be
5654 submitted to the voters at an election to be held November 4, 2025.
5755 The ballot shall be printed to permit voting for or against the
5856 proposition: "The constitutional amendment providing for the
5957 creation of the Texas nuclear development fund to support the
6058 development, construction, and operation of advanced nuclear
6159 reactor projects for dispatchable electric generation."
