| 9 | 9 | | procedures, including in vitro fertilization. |

| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article I, Texas Constitution, is amended by |
|---|
| 12 | 12 | | adding Sections 37 and 38 to read as follows: |
|---|
| 13 | 13 | | Sec. 37. (a) Except as otherwise provided by this section, |
|---|
| 14 | 14 | | a pregnant individual has the right to obtain an abortion in this |
|---|
| 15 | 15 | | state. |
|---|
| 16 | 16 | | (b) Before a fetus is viable or when an abortion is |
|---|
| 17 | 17 | | necessary to protect a pregnant individual's health as determined |
|---|
| 18 | 18 | | by the individual's health care provider, this state may not: |
|---|
| 19 | 19 | | (1) prohibit or restrict the right of the individual |
|---|
| 20 | 20 | | to obtain an abortion; or |
|---|
| 21 | 21 | | (2) penalize a health care provider authorized under |
|---|
| 22 | 22 | | state law to perform or induce an abortion for the performance or |
|---|
| 23 | 23 | | inducement. |
|---|
| 24 | 24 | | Sec. 38. Each individual residing in this state has the |
|---|
| 25 | 25 | | right to obtain assisted reproductive technology treatments and |
|---|
| 26 | 26 | | procedures, including in vitro fertilization. This state may |
|---|
| 27 | 27 | | regulate the provision of the treatments and procedures to the |
|---|
| 28 | 28 | | extent necessary to protect an individual's health. |
|---|
| 29 | 29 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 30 | 30 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 31 | 31 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 32 | 32 | | proposition: "The constitutional amendment guaranteeing the rights |
|---|
| 33 | 33 | | to an abortion and to assisted reproductive technology treatments |
|---|
| 34 | 34 | | and procedures, including in vitro fertilization." |
