66 A JOINT RESOLUTION
77 proposing a constitutional amendment guaranteeing the rights to an
88 abortion and to assisted reproductive technology treatments and
99 procedures, including in vitro fertilization.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article I, Texas Constitution, is amended by
1212 adding Sections 37 and 38 to read as follows:
1313 Sec. 37. (a) Except as otherwise provided by this section,
1414 a pregnant individual has the right to obtain an abortion in this
1515 state.
1616 (b) Before a fetus is viable or when an abortion is
1717 necessary to protect a pregnant individual's health as determined
1818 by the individual's health care provider, this state may not:
1919 (1) prohibit or restrict the right of the individual
2020 to obtain an abortion; or
2121 (2) penalize a health care provider authorized under
2222 state law to perform or induce an abortion for the performance or
2323 inducement.
2424 Sec. 38. Each individual residing in this state has the
2525 right to obtain assisted reproductive technology treatments and
2626 procedures, including in vitro fertilization. This state may
2727 regulate the provision of the treatments and procedures to the
2828 extent necessary to protect an individual's health.
2929 SECTION 2. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 4, 2025.
3131 The ballot shall be printed to provide for voting for or against the
3232 proposition: "The constitutional amendment guaranteeing the rights
3333 to an abortion and to assisted reproductive technology treatments
3434 and procedures, including in vitro fertilization."
