611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to declination, cancellation, or nonrenewal of insurance
914 policies.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 551.001(a), Insurance Code, is amended
1217 to read as follows:
1318 (a) The commissioner may, as necessary, adopt and enforce
1419 reasonable rules, including notice requirements, relating to the
1520 declination, cancellation, and nonrenewal of any insurance policy
1621 regulated by the department under:
1722 (1) Chapter 5;
1823 (2) Chapter 1804, 1805, 2171, or 2301; or
1924 (3) Subtitle C, D, E, or F, Title 10.
2025 SECTION 2. Section 551.002(a), Insurance Code, is amended
2126 to read as follows:
2227 (a) The commissioner shall require an insurer that
2328 declines, cancels, or refuses to renew an insurance policy to which
2429 Section 551.001 applies[, on request by an applicant for insurance
2530 or a policyholder,] to provide to the applicant or policyholder a
2631 written statement of the reasons for the declination, cancellation,
2732 or nonrenewal of the [an insurance] policy [to which Section
2833 551.001 applies].
2934 SECTION 3. Subchapter A, Chapter 551, Insurance Code, is
3035 amended by adding Section 551.006 to read as follows:
31- Sec. 551.006. QUARTERLY REPORT. (a) An insurer shall
32- provide to the department each quarter a written report summarizing
33- the insurer's written statements of reasons for declination,
36+ Sec. 551.006. QUARTERLY REPORT. An insurer shall provide
37+ to the department each quarter a written report summarizing the
38+ insurer's written statements of reasons for declination,
3439 cancellation, or nonrenewal provided to applicants for insurance or
3540 policyholders as required by this chapter. The report must be:
3641 (1) in the form and manner prescribed by the
3742 commissioner; and
3843 (2) organized by the zip code of the applicant or
3944 policyholder that received the statement.
40- (b) A report under this section must disclose any decision
41- to decline to issue, cancel, or refuse to renew an insurance policy
42- that was based on:
43- (1) a score that is based on measuring exposure to
44- long-term environmental, social, or governance risks; or
45- (2) diversity, equity, and inclusion factors.
46- (c) The department shall post reports provided under this
47- section on the department's Internet website.
4845 SECTION 4. Subchapter B, Chapter 551, Insurance Code, is
4946 amended by adding Section 551.0521 to read as follows:
5047 Sec. 551.0521. WRITTEN NOTICE OF DECLINATION REQUIRED. An
5148 insurer that declines an application for a liability insurance or
5249 commercial property insurance policy shall deliver or mail written
5350 notice of the declination to the applicant.
5451 SECTION 5. Section 551.055, Insurance Code, is amended to
5552 read as follows:
5653 Sec. 551.055. REASON FOR DECLINATION, CANCELLATION, OR
5754 NONRENEWAL REQUIRED. In a notice to an applicant or insured
5855 relating to declination, cancellation, or refusal to renew, an
5956 insurer must state the reason for the declination, cancellation, or
6057 nonrenewal. The statement must comply with:
6158 (1) Sections 551.002(b) and (c); and
6259 (2) rules adopted under Section 551.002(d).
6360 SECTION 6. Section 551.109, Insurance Code, is amended to
6461 read as follows:
6562 Sec. 551.109. INSURER STATEMENT. An insurer shall[, at the
6663 request of an applicant for insurance or an insured,] provide a
6764 written statement of the reason for a declination, cancellation, or
6865 nonrenewal of an insurance policy. The statement must comply with:
6966 (1) Sections 551.002(b) and (c); and
7067 (2) rules adopted under Section 551.002(d).
7168 SECTION 7. The change in law made by this Act applies only
7269 to an application for insurance that is made or an insurance policy
7370 that is delivered, issued for delivery, or renewed on or after the
7471 effective date of this Act. An application made or policy
7572 delivered, issued for delivery, or renewed before the effective
7673 date of this Act is governed by the law as it existed immediately
7774 before the effective date of this Act, and that law is continued in
7875 effect for that purpose.
7976 SECTION 8. This Act takes effect September 1, 2025.
