| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 54.535, Education Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (a) and adding Subsections (a-1), (a-2), and |
|---|
| 14 | 14 | | (a-3) to read as follows: |
|---|
| 15 | 15 | | (a) The board of regents of The University of Texas System |
|---|
| 16 | 16 | | may levy a student union fee in an amount not to exceed $150 [$30] |
|---|
| 17 | 17 | | per student for each semester or term of 10 [regular semester or |
|---|
| 18 | 18 | | each summer session of six] weeks or more, and not to exceed $75 |
|---|
| 19 | 19 | | [$15] per student for any other semester or term [each summer |
|---|
| 20 | 20 | | session of less than six weeks], for the sole purpose of financing, |
|---|
| 21 | 21 | | constructing, operating, maintaining, and improving a student |
|---|
| 22 | 22 | | union building for The University of Texas at El Paso, including |
|---|
| 23 | 23 | | demolition of the existing student union building; provided, |
|---|
| 24 | 24 | | however, that the fee may not be increased to an amount that exceeds |
|---|
| 25 | 25 | | by at least 10 percent the amount of the fee levied during the |
|---|
| 26 | 26 | | preceding academic year, [above $15 per student for each regular |
|---|
| 27 | 27 | | semester or each summer session of six weeks or more and $7.50 per |
|---|
| 28 | 28 | | student for each summer session of less than six weeks] unless the |
|---|
| 29 | 29 | | increase is approved by a majority vote of [those] students |
|---|
| 30 | 30 | | enrolled at the university participating in a general student |
|---|
| 31 | 31 | | election held for that purpose. The fees herein authorized to be |
|---|
| 32 | 32 | | levied are in addition to any use or service fee now or hereafter |
|---|
| 33 | 33 | | authorized to be levied. |
|---|
| 34 | 34 | | (a-1) Notwithstanding Subsection (a), for a semester or |
|---|
| 35 | 35 | | term before the 2026 fall semester, the amount of a fee levied under |
|---|
| 36 | 36 | | this section may not exceed: |
|---|
| 37 | 37 | | (1) $70 per student for a semester or term of 10 weeks |
|---|
| 38 | 38 | | or more; or |
|---|
| 39 | 39 | | (2) $35 per student for a semester or term not |
|---|
| 40 | 40 | | described by Subdivision (1). |
|---|
| 41 | 41 | | (a-2) Notwithstanding Subsection (a), for a semester or |
|---|
| 42 | 42 | | term of the 2026-2027 academic year, the amount of a fee levied |
|---|
| 43 | 43 | | under this section may not exceed: |
|---|
| 44 | 44 | | (1) $120 per student for a semester or term of 10 weeks |
|---|
| 45 | 45 | | or more; or |
|---|
| 46 | 46 | | (2) $60 per student for a semester or term not |
|---|
| 47 | 47 | | described by Subdivision (1). |
|---|
| 48 | 48 | | (a-3) Subsections (a-1) and (a-2) and this subsection |
|---|
| 49 | 49 | | expire September 1, 2027. |
|---|
| 50 | 50 | | SECTION 2. Section 54.535, Education Code, as amended by |
|---|
| 51 | 51 | | this Act, applies beginning with student union fees collected for |
|---|
| 52 | 52 | | the 2026 spring semester. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect September 1, 2025. |
