69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to distribution of state traffic fine revenue received by
912 the comptroller.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Sections 542.4031(g) and (h), Transportation
1215 Code, are amended to read as follows:
1316 (g) Of the money received by the comptroller under this
1417 section, the comptroller shall deposit:
1518 (1) 50 [70] percent to the credit of the undedicated
1619 portion of the general revenue fund; and
1720 (2) 50 [30] percent to the credit of the designated
1821 trauma facility and emergency medical services account under
1922 Section 780.003, Health and Safety Code.
2023 (h) Notwithstanding Subsection (g)(1), in any state fiscal
2124 year the comptroller shall deposit 50 [70] percent of the money
2225 received under Subsection (e)(2) to the credit of the general
2326 revenue fund only until the total amount of the money deposited to
2427 the credit of the general revenue fund under Subsection (g)(1)
2528 equals $250 million for that year. If in any state fiscal year the
2629 amount received by the comptroller under Subsection (e)(2) for
2730 deposit to the credit of the general revenue fund under Subsection
2831 (g)(1) exceeds $250 million, the comptroller shall deposit the
2932 additional amount to the credit of the Texas mobility fund.
3033 SECTION 2. Section 542.4031(g), Transportation Code, as
3134 amended by this Act, applies only to the distribution of revenue
3235 collected on or after the effective date of this Act. The
3336 distribution of revenue collected before the effective date of this
3437 Act is governed by the law in effect at the time the revenue was
3538 collected, and that law is continued in effect for the purpose of
3639 the distribution of that revenue.
3740 SECTION 3. This Act takes effect September 1, 2025.
