| 9 | 9 | | relating to the qualifications for serving as a member of the board |

| 10 | 10 | | of directors of certain municipal utility districts. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 54.102, Water Code, is amended to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | Sec. 54.102. QUALIFICATIONS FOR DIRECTORS. To be qualified |
|---|
| 15 | 15 | | to serve as a director, a person shall: |
|---|
| 16 | 16 | | (1) be at least 18 years old; |
|---|
| 17 | 17 | | (2) be[,] a resident citizen of the State of Texas; [,] |
|---|
| 18 | 18 | | and |
|---|
| 19 | 19 | | (3) either own land subject to taxation in the |
|---|
| 20 | 20 | | district or be a qualified voter within the district. |
|---|
| 21 | 21 | | SECTION 2. Subchapter C, Chapter 54, Water Code, is amended |
|---|
| 22 | 22 | | by adding Section 54.103 to read as follows: |
|---|
| 23 | 23 | | Sec. 54.103. QUALIFICATIONS FOR DIRECTORS IN CERTAIN |
|---|
| 24 | 24 | | COUNTIES. (a) This section applies only to a district wholly or |
|---|
| 25 | 25 | | partly located in a county that: |
|---|
| 26 | 26 | | (1) borders the United Mexican States; and |
|---|
| 27 | 27 | | (2) contains a municipality with a population of more |
|---|
| 28 | 28 | | than 500,000. |
|---|
| 29 | 29 | | (b) Notwithstanding Section 54.102, to be qualified to |
|---|
| 30 | 30 | | serve as a director of a district to which this section applies, a |
|---|
| 31 | 31 | | person shall: |
|---|
| 32 | 32 | | (1) meet the requirements of Sections 54.102(1) and |
|---|
| 33 | 33 | | (2); and |
|---|
| 34 | 34 | | (2) be a qualified voter within the district. |
|---|
| 35 | 35 | | SECTION 3. Section 54.103, Water Code, as added by this Act, |
|---|
| 36 | 36 | | does not affect the entitlement of a member serving immediately |
|---|
| 37 | 37 | | before the effective date of this Act on the board of directors of a |
|---|
| 38 | 38 | | municipal utility district described by that section to continue to |
|---|
| 39 | 39 | | carry out the board's functions for the remainder of the member's |
|---|
| 40 | 40 | | term. That section applies only to a member of the board of |
|---|
| 41 | 41 | | directors of such a district elected or appointed on or after the |
|---|
| 42 | 42 | | effective date of this Act. That section does not prohibit a person |
|---|
| 43 | 43 | | who is a member of the board of directors of such a district on the |
|---|
| 44 | 44 | | effective date of this Act from being reelected or reappointed to |
|---|
| 45 | 45 | | the board if the person has the qualifications required for a member |
|---|
| 46 | 46 | | under that section. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect September 1, 2025. |
