| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 62.161(2), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (2) "Eligible institution" means a general academic |
|---|
| 14 | 14 | | teaching institution ,private or independent institution of higher |
|---|
| 15 | 15 | | education, or medical and dental unit. |
|---|
| 16 | 16 | | SECTION 2. Section 62.163, Education Code, is amended to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | (d) A matching grant may not be used by an eligible |
|---|
| 19 | 19 | | institution to recruit a distinguished researcher from[: |
|---|
| 20 | 20 | | (1)] another eligible institution[; or |
|---|
| 21 | 21 | | (2) a private or independent institution of higher |
|---|
| 22 | 22 | | education]. |
|---|
| 23 | 23 | | SECTION 3. The changes made to Sections 62.161(2) and |
|---|
| 24 | 24 | | 62.163(d), Education Code, as amended by this Act, applies only to |
|---|
| 25 | 25 | | an agreement entered into under Subchapter H, Chapter 62, Education |
|---|
| 26 | 26 | | Code, on or after the effective date of this Act. |
|---|
| 27 | 27 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2025. |
