69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the withdrawal of a candidate in a runoff primary
912 election.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 2.023(a), Election Code, is amended to
1215 read as follows:
1316 (a) Except as provided by Subsections (b) and (c) or Section
1417 172.059, the candidates in a runoff election are the candidates who
1518 receive the highest and second highest number of votes in the main
1619 election or who tie for the highest number of votes.
1720 SECTION 2. Section 172.059, Election Code, is amended by
1821 amending Subsections (a) and (c) and adding Subsection (d) to read
1922 as follows:
2023 (a) A candidate for nomination may not withdraw from the
2124 runoff primary election after 5 p.m. of the fifth [3rd] day after
2225 the last day on which the state canvass may be conducted for the
2326 election under Section 172.120(b) [172.120].
2427 (c) If a runoff candidate withdraws from the election on or
2528 before 5 p.m. of the fifth day after the last day on which the state
2629 canvass may be conducted for the election, the candidate who
2730 received the third highest number of votes in the general primary
2831 election is entitled to a place on the runoff ballot.
2932 (d) If a runoff candidate withdraws after 5 p.m. of the
3033 fifth day after the last day on which the state canvass may be
3134 conducted for the election, the remaining candidate is the nominee
3235 and the runoff election for that office is not held.
3336 SECTION 3. The changes in law made by this Act apply to an
3437 election ordered on or after the effective date of this Act. An
3538 election ordered before the effective date of this Act is governed
3639 by the law in effect when the election was ordered, and the former
3740 law is continued in effect for that purpose.
3841 SECTION 4. This Act takes effect September 1, 2025.
