77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the availability of paper ballots for a person voting by
1010 personal appearance.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 51.005(a), Election Code, is amended to
1313 read as follows:
1414 (a) The authority responsible for procuring the election
1515 supplies for an election shall provide:
1616 (1) for each election precinct, a number of ballots
1717 equal to at least the percentage of voters who voted in that
1818 precinct in the most recent corresponding election plus 25 percent
1919 of that number, except that the number of ballots provided may not
2020 exceed the total number of registered voters in the precinct; and
2121 (2) unless the number of ballots provided to an
2222 election precinct is equal to the total number of registered voters
2323 in the precinct, the means to print additional paper ballots at each
2424 precinct polling place and early voting polling place.
2525 SECTION 2. Subchapter A, Chapter 125, Election Code, is
2626 amended by adding Section 125.0071 to read as follows:
2727 Sec. 125.0071. PROVISION OF PAPER BALLOT TO CERTAIN VOTERS.
2828 (a) An election officer shall provide a paper ballot to a voter who
2929 requests a paper ballot.
3030 (b) The secretary of state may prescribe procedures to
3131 implement this section.
3232 SECTION 3. The changes in law made by this Act apply to an
3333 election ordered on or after the effective date of this Act. An
3434 election ordered before the effective date of this Act is governed
3535 by the law in effect when the election was ordered, and the former
3636 law is continued in effect for that purpose.
3737 SECTION 4. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2025.
