| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 2001.029(b), Government Code, is amended | |
| 13 | 13 | to read as follows: | |
| 14 | 14 | (b) A state agency shall grant an opportunity for a public | |
| 15 | 15 | hearing before it adopts a substantive rule if a public hearing is | |
| 16 | 16 | requested by: | |
| 17 | 17 | (1) at least 10 [25] persons; | |
| 18 | 18 | (2) a governmental subdivision or agency; [or] | |
| 19 | 19 | (3) the lieutenant governor or a member of the | |
| 20 | 20 | legislature; or | |
| 21 | 21 | (4) an association having at least 10 [25] members. | |
| 22 | 22 | SECTION 2. Section 2001.029(b), Government Code, as amended | |
| 23 | 23 | by this Act, applies only to a rule proposed by a state agency on or | |
| 24 | 24 | after the effective date of this Act. A rule proposed before the | |
| 25 | 25 | effective date of this Act is governed by the law in effect | |
| 26 | 26 | immediately before that date, and the former law is continued in | |
| 27 | 27 | effect for that purpose. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2025. |
