77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the composition of the Health and Human Services
1010 Commission Executive Council.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 523.0103(a) and (c), Government Code,
1313 as effective April 1, 2025, are amended to read as follows:
1414 (a) The executive council is composed of:
1515 (1) the executive commissioner;
1616 (2) the director of each division the executive
1717 commissioner established under former Section 531.008(c) before
1818 the expiration of that subsection on September 1, 2023;
1919 (3) the commissioner of a health and human services
2020 agency;
2121 (4) the commissioner of the Department of Family and
2222 Protective Services, regardless of whether that agency continues as
2323 a state agency separate from the commission; [and]
2424 (5) at least one parent or guardian of a child with a
2525 disability who is a Medicaid recipient, including a recipient of
2626 services under a Medicaid waiver program, appointed by the
2727 executive commissioner; and
2828 (6) other individuals the executive commissioner
2929 appoints as the executive commissioner determines necessary.
3030 (c) An executive council member appointed under Subsection
3131 (a)(5) or (6) serves at the executive commissioner's pleasure.
3232 SECTION 2. Section 523.0107, Government Code, as effective
3333 April 1, 2025, is amended to read as follows:
3434 Sec. 523.0107. COMPENSATION; REIMBURSEMENT FOR
3535 EXPENSES. An executive council member appointed under Section
3636 523.0103(a)(5) or (6) may not receive compensation for service as a
3737 council member but is entitled to reimbursement for travel expenses
3838 the member incurs while conducting council business as provided by
3939 the General Appropriations Act.
4040 SECTION 3. As soon as practicable after the effective date
4141 of this Act, the executive commissioner of the Health and Human
4242 Services Commission shall appoint at least one parent or guardian
4343 of a child with a disability to the commission's executive council
4444 as required by Section 523.0103(a)(5), Government Code, as amended
4545 by this Act.
4646 SECTION 4. This Act takes effect September 1, 2025.
