| 10 | 10 | | Commission Executive Council. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 523.0103(a) and (c), Government Code, |
|---|
| 13 | 13 | | as effective April 1, 2025, are amended to read as follows: |
|---|
| 14 | 14 | | (a) The executive council is composed of: |
|---|
| 15 | 15 | | (1) the executive commissioner; |
|---|
| 16 | 16 | | (2) the director of each division the executive |
|---|
| 17 | 17 | | commissioner established under former Section 531.008(c) before |
|---|
| 18 | 18 | | the expiration of that subsection on September 1, 2023; |
|---|
| 19 | 19 | | (3) the commissioner of a health and human services |
|---|
| 20 | 20 | | agency; |
|---|
| 21 | 21 | | (4) the commissioner of the Department of Family and |
|---|
| 22 | 22 | | Protective Services, regardless of whether that agency continues as |
|---|
| 23 | 23 | | a state agency separate from the commission; [and] |
|---|
| 24 | 24 | | (5) at least one parent or guardian of a child with a |
|---|
| 25 | 25 | | disability who is a Medicaid recipient, including a recipient of |
|---|
| 26 | 26 | | services under a Medicaid waiver program, appointed by the |
|---|
| 27 | 27 | | executive commissioner; and |
|---|
| 28 | 28 | | (6) other individuals the executive commissioner |
|---|
| 29 | 29 | | appoints as the executive commissioner determines necessary. |
|---|
| 30 | 30 | | (c) An executive council member appointed under Subsection |
|---|
| 31 | 31 | | (a)(5) or (6) serves at the executive commissioner's pleasure. |
|---|
| 32 | 32 | | SECTION 2. Section 523.0107, Government Code, as effective |
|---|
| 33 | 33 | | April 1, 2025, is amended to read as follows: |
|---|
| 34 | 34 | | Sec. 523.0107. COMPENSATION; REIMBURSEMENT FOR |
|---|
| 35 | 35 | | EXPENSES. An executive council member appointed under Section |
|---|
| 36 | 36 | | 523.0103(a)(5) or (6) may not receive compensation for service as a |
|---|
| 37 | 37 | | council member but is entitled to reimbursement for travel expenses |
|---|
| 38 | 38 | | the member incurs while conducting council business as provided by |
|---|
| 39 | 39 | | the General Appropriations Act. |
|---|
| 40 | 40 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 41 | 41 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 42 | 42 | | Services Commission shall appoint at least one parent or guardian |
|---|
| 43 | 43 | | of a child with a disability to the commission's executive council |
|---|
| 44 | 44 | | as required by Section 523.0103(a)(5), Government Code, as amended |
|---|
| 45 | 45 | | by this Act. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect September 1, 2025. |
