88 AN ACT
99 relating to the creation of the criminal offense of oil and gas
1010 equipment theft.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 31.19, Penal Code, is
1313 amended to read as follows:
1414 Sec. 31.19. THEFT OF PETROLEUM PRODUCT OR OIL AND GAS
1515 EQUIPMENT.
1616 SECTION 2. Section 31.19, Penal Code, is amended by
1717 amending Subsections (a), (c), and (d) and adding Subsections
1818 (b-1), (e), and (f) to read as follows:
1919 (a) In this section:
2020 (1) "Oil and gas equipment" means machinery, drilling
2121 equipment, welding equipment, pipeline equipment, fittings, pumps,
2222 vehicles, or other equipment and materials that are part of or
2323 incident to the exploration, development, maintenance, and
2424 operation of oil and gas properties, including oil and gas wells,
2525 oil and gas leases, gasoline plants, and refineries.
2626 (2) "Petroleum [, "petroleum] product" means crude
2727 oil, natural gas, or condensate.
2828 (b-1) A person commits an offense if the person unlawfully
2929 appropriates oil and gas equipment with intent to deprive the owner
3030 of the oil and gas equipment by possessing, removing, delivering,
3131 receiving, purchasing, selling, moving, concealing, or
3232 transporting the oil and gas equipment.
3333 (c) Appropriation of a petroleum product or oil and gas
3434 equipment is unlawful if it is without the owner's effective
3535 consent.
3636 (d) An offense under Subsection (b) [this section] is:
3737 (1) a state jail felony if the total value of the
3838 petroleum product appropriated is less than $10,000;
3939 (2) a felony of the third degree if the total value of
4040 the petroleum product appropriated is $10,000 or more but less than
4141 $100,000;
4242 (3) a felony of the second degree if the total value of
4343 the petroleum product appropriated is $100,000 or more but less
4444 than $300,000; or
4545 (4) a felony of the first degree if the total value of
4646 the petroleum product appropriated is $300,000 or more.
4747 (e) An offense under Subsection (b-1) is:
4848 (1) a state jail felony if the total value of the oil
4949 and gas equipment appropriated is $2,500 or more but less than
5050 $10,000;
5151 (2) a felony of the third degree if the total value of
5252 the oil and gas equipment appropriated is $10,000 or more but less
5353 than $100,000;
5454 (3) a felony of the second degree if the total value of
5555 the oil and gas equipment appropriated is $100,000 or more but less
5656 than $300,000; or
5757 (4) a felony of the first degree if the total value of
5858 the oil and gas equipment appropriated is $300,000 or more.
5959 (f) If conduct constituting an offense under this section is
6060 also an offense under another law, the actor may be prosecuted under
6161 this section, the other law, or both.
6262 SECTION 3. This Act takes effect September 1, 2025.
