| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 31.19, Penal Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 31.19. THEFT OF PETROLEUM PRODUCT OR OIL AND GAS |
|---|
| 15 | 15 | | EQUIPMENT. |
|---|
| 16 | 16 | | SECTION 2. Section 31.19, Penal Code, is amended by |
|---|
| 17 | 17 | | amending Subsections (a), (c), and (d) and adding Subsections |
|---|
| 18 | 18 | | (b-1), (e), and (f) to read as follows: |
|---|
| 19 | 19 | | (a) In this section: |
|---|
| 20 | 20 | | (1) "Oil and gas equipment" means machinery, drilling |
|---|
| 21 | 21 | | equipment, welding equipment, pipeline equipment, fittings, pumps, |
|---|
| 22 | 22 | | vehicles, or other equipment and materials that are part of or |
|---|
| 23 | 23 | | incident to the exploration, development, maintenance, and |
|---|
| 24 | 24 | | operation of oil and gas properties, including oil and gas wells, |
|---|
| 25 | 25 | | oil and gas leases, gasoline plants, and refineries. |
|---|
| 26 | 26 | | (2) "Petroleum [, "petroleum] product" means crude |
|---|
| 27 | 27 | | oil, natural gas, or condensate. |
|---|
| 28 | 28 | | (b-1) A person commits an offense if the person unlawfully |
|---|
| 29 | 29 | | appropriates oil and gas equipment with intent to deprive the owner |
|---|
| 30 | 30 | | of the oil and gas equipment by possessing, removing, delivering, |
|---|
| 31 | 31 | | receiving, purchasing, selling, moving, concealing, or |
|---|
| 32 | 32 | | transporting the oil and gas equipment. |
|---|
| 33 | 33 | | (c) Appropriation of a petroleum product or oil and gas |
|---|
| 34 | 34 | | equipment is unlawful if it is without the owner's effective |
|---|
| 35 | 35 | | consent. |
|---|
| 36 | 36 | | (d) An offense under Subsection (b) [this section] is: |
|---|
| 37 | 37 | | (1) a state jail felony if the total value of the |
|---|
| 38 | 38 | | petroleum product appropriated is less than $10,000; |
|---|
| 39 | 39 | | (2) a felony of the third degree if the total value of |
|---|
| 40 | 40 | | the petroleum product appropriated is $10,000 or more but less than |
|---|
| 41 | 41 | | $100,000; |
|---|
| 42 | 42 | | (3) a felony of the second degree if the total value of |
|---|
| 43 | 43 | | the petroleum product appropriated is $100,000 or more but less |
|---|
| 44 | 44 | | than $300,000; or |
|---|
| 45 | 45 | | (4) a felony of the first degree if the total value of |
|---|
| 46 | 46 | | the petroleum product appropriated is $300,000 or more. |
|---|
| 47 | 47 | | (e) An offense under Subsection (b-1) is: |
|---|
| 48 | 48 | | (1) a state jail felony if the total value of the oil |
|---|
| 49 | 49 | | and gas equipment appropriated is $2,500 or more but less than |
|---|
| 50 | 50 | | $10,000; |
|---|
| 51 | 51 | | (2) a felony of the third degree if the total value of |
|---|
| 52 | 52 | | the oil and gas equipment appropriated is $10,000 or more but less |
|---|
| 53 | 53 | | than $100,000; |
|---|
| 54 | 54 | | (3) a felony of the second degree if the total value of |
|---|
| 55 | 55 | | the oil and gas equipment appropriated is $100,000 or more but less |
|---|
| 56 | 56 | | than $300,000; or |
|---|
| 57 | 57 | | (4) a felony of the first degree if the total value of |
|---|
| 58 | 58 | | the oil and gas equipment appropriated is $300,000 or more. |
|---|
| 59 | 59 | | (f) If conduct constituting an offense under this section is |
|---|
| 60 | 60 | | also an offense under another law, the actor may be prosecuted under |
|---|
| 61 | 61 | | this section, the other law, or both. |
|---|
| 62 | 62 | | SECTION 3. This Act takes effect September 1, 2025. |
