611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the requirement for performance and payment bonds from
914 certain contractors of the Parks and Wildlife Department.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 11.0171, Parks and Wildlife Code, is
1217 amended by adding Subsection (a-1) to read as follows:
1318 (a-1) If the value of a contract under Subsection (a)(2) for
1419 constructing, altering, or repairing a public building or carrying
1520 out or completing any public work exceeds $150,000, the department,
1621 the executive director, or the executive director's designee shall
1722 require the contractor to execute a performance bond and a payment
1823 bond to the department before beginning work.
1924 SECTION 2. Section 11.0171(a-1), Parks and Wildlife Code,
2025 as added by this Act, applies only to a contract for which the Parks
2126 and Wildlife Department first advertises or otherwise requests
2227 bids, proposals, offers, or qualifications, or makes a similar
2328 solicitation, on or after the effective date of this Act. A
2429 contract for which the department first advertises or otherwise
2530 requests bids, proposals, offers, or qualifications, or makes a
2631 similar solicitation, before the effective date of this Act is
2732 governed by the law as it existed immediately before that date, and
2833 that law is continued in effect for that purpose.
2934 SECTION 3. This Act takes effect September 1, 2025.
