| 9 | 14 | | certain contractors of the Parks and Wildlife Department. |

| 10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 16 | | SECTION 1. Section 11.0171, Parks and Wildlife Code, is |
|---|
| 12 | 17 | | amended by adding Subsection (a-1) to read as follows: |
|---|
| 13 | 18 | | (a-1) If the value of a contract under Subsection (a)(2) for |
|---|
| 14 | 19 | | constructing, altering, or repairing a public building or carrying |
|---|
| 15 | 20 | | out or completing any public work exceeds $150,000, the department, |
|---|
| 16 | 21 | | the executive director, or the executive director's designee shall |
|---|
| 17 | 22 | | require the contractor to execute a performance bond and a payment |
|---|
| 18 | 23 | | bond to the department before beginning work. |
|---|
| 19 | 24 | | SECTION 2. Section 11.0171(a-1), Parks and Wildlife Code, |
|---|
| 20 | 25 | | as added by this Act, applies only to a contract for which the Parks |
|---|
| 21 | 26 | | and Wildlife Department first advertises or otherwise requests |
|---|
| 22 | 27 | | bids, proposals, offers, or qualifications, or makes a similar |
|---|
| 23 | 28 | | solicitation, on or after the effective date of this Act. A |
|---|
| 24 | 29 | | contract for which the department first advertises or otherwise |
|---|
| 25 | 30 | | requests bids, proposals, offers, or qualifications, or makes a |
|---|
| 26 | 31 | | similar solicitation, before the effective date of this Act is |
|---|
| 27 | 32 | | governed by the law as it existed immediately before that date, and |
|---|
| 28 | 33 | | that law is continued in effect for that purpose. |
|---|
| 29 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
