611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to prohibiting public institutions of higher education and
914 employees of public institutions of higher education and their
1015 spouses from soliciting or accepting gifts, grants, donations, or
1116 investments from certain foreign entities.
1217 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1318 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1419 amended by adding Section 51.984 to read as follows:
1520 Sec. 51.984. PROHIBITION ON SOLICITING OR ACCEPTING GIFTS,
1621 GRANTS, DONATIONS, OR INVESTMENTS FROM CERTAIN FOREIGN ENTITIES.
1722 (a) In this section:
1823 (1) "Designated country" means:
1924 (A) a country identified by the United States
2025 director of national intelligence as a country that poses a risk to
2126 the national security of the United States in at least one of the
2227 three most recent Annual Threat Assessments of the U.S.
2328 Intelligence Community issued pursuant to Section 108B, National
2429 Security Act of 1947 (50 U.S.C. Section 3043b); and
2530 (B) a country designated by the governor after
2631 consultation with the director of the Department of Public Safety.
2732 (2) "Institution of higher education" has the meaning
2833 assigned by Section 61.003.
2934 (b) Notwithstanding any other law, an institution of higher
3035 education or an employee or spouse of an employee of an institution
3136 of higher education in the employee's or spouse's official or
3237 private capacity may not solicit or accept a gift, grant, donation,
3338 or investment from:
3439 (1) a governmental entity of a designated country;
3540 (2) a political party of a designated country,
3641 including private money from any party member; or
3742 (3) a company:
3843 (A) that is headquartered in a designated
3944 country; and
4045 (B) in which a governmental entity of a
4146 designated country holds an ownership interest.
4247 (c) An institution of higher education shall include in any
4348 employment contract entered into between the institution and an
4449 employee a prohibition against the conduct described by Subsection
4550 (b) by the employee or spouse of the employee.
4651 (d) An institution of higher education or an employee or
4752 spouse of an employee of an institution of higher education shall
4853 return any money or other thing of value received in violation of
4954 this section during the preceding state fiscal biennium to the
5055 entity or entities that provided the money or other thing of value
5156 to the institution, employee, or spouse of the employee.
5257 (e) The Texas Higher Education Coordinating Board may adopt
5358 rules as necessary to implement this section.
5459 SECTION 2. Section 51.984(c), Education Code, as added by
5560 this Act, applies only to a contract entered into or renewed on or
5661 after the effective date of this Act. A contract entered into or
5762 renewed before that date is governed by the law in effect on the
5863 date the contract was entered into or renewed, and the former law is
5964 continued in effect for that purpose.
6065 SECTION 3. This Act takes effect September 1, 2025.
