| 12 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 18 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 14 | 19 | | amended by adding Section 51.984 to read as follows: |
|---|
| 15 | 20 | | Sec. 51.984. PROHIBITION ON SOLICITING OR ACCEPTING GIFTS, |
|---|
| 16 | 21 | | GRANTS, DONATIONS, OR INVESTMENTS FROM CERTAIN FOREIGN ENTITIES. |
|---|
| 17 | 22 | | (a) In this section: |
|---|
| 18 | 23 | | (1) "Designated country" means: |
|---|
| 19 | 24 | | (A) a country identified by the United States |
|---|
| 20 | 25 | | director of national intelligence as a country that poses a risk to |
|---|
| 21 | 26 | | the national security of the United States in at least one of the |
|---|
| 22 | 27 | | three most recent Annual Threat Assessments of the U.S. |
|---|
| 23 | 28 | | Intelligence Community issued pursuant to Section 108B, National |
|---|
| 24 | 29 | | Security Act of 1947 (50 U.S.C. Section 3043b); and |
|---|
| 25 | 30 | | (B) a country designated by the governor after |
|---|
| 26 | 31 | | consultation with the director of the Department of Public Safety. |
|---|
| 27 | 32 | | (2) "Institution of higher education" has the meaning |
|---|
| 28 | 33 | | assigned by Section 61.003. |
|---|
| 29 | 34 | | (b) Notwithstanding any other law, an institution of higher |
|---|
| 30 | 35 | | education or an employee or spouse of an employee of an institution |
|---|
| 31 | 36 | | of higher education in the employee's or spouse's official or |
|---|
| 32 | 37 | | private capacity may not solicit or accept a gift, grant, donation, |
|---|
| 33 | 38 | | or investment from: |
|---|
| 34 | 39 | | (1) a governmental entity of a designated country; |
|---|
| 35 | 40 | | (2) a political party of a designated country, |
|---|
| 36 | 41 | | including private money from any party member; or |
|---|
| 37 | 42 | | (3) a company: |
|---|
| 38 | 43 | | (A) that is headquartered in a designated |
|---|
| 39 | 44 | | country; and |
|---|
| 40 | 45 | | (B) in which a governmental entity of a |
|---|
| 41 | 46 | | designated country holds an ownership interest. |
|---|
| 42 | 47 | | (c) An institution of higher education shall include in any |
|---|
| 43 | 48 | | employment contract entered into between the institution and an |
|---|
| 44 | 49 | | employee a prohibition against the conduct described by Subsection |
|---|
| 45 | 50 | | (b) by the employee or spouse of the employee. |
|---|
| 46 | 51 | | (d) An institution of higher education or an employee or |
|---|
| 47 | 52 | | spouse of an employee of an institution of higher education shall |
|---|
| 48 | 53 | | return any money or other thing of value received in violation of |
|---|
| 49 | 54 | | this section during the preceding state fiscal biennium to the |
|---|
| 50 | 55 | | entity or entities that provided the money or other thing of value |
|---|
| 51 | 56 | | to the institution, employee, or spouse of the employee. |
|---|
| 52 | 57 | | (e) The Texas Higher Education Coordinating Board may adopt |
|---|
| 53 | 58 | | rules as necessary to implement this section. |
|---|
| 54 | 59 | | SECTION 2. Section 51.984(c), Education Code, as added by |
|---|
| 55 | 60 | | this Act, applies only to a contract entered into or renewed on or |
|---|
| 56 | 61 | | after the effective date of this Act. A contract entered into or |
|---|
| 57 | 62 | | renewed before that date is governed by the law in effect on the |
|---|
| 58 | 63 | | date the contract was entered into or renewed, and the former law is |
|---|
| 59 | 64 | | continued in effect for that purpose. |
|---|
| 60 | 65 | | SECTION 3. This Act takes effect September 1, 2025. |
